The Regular Board Meeting of the Town Board of the Town of Macedon held October 26, 2017 at the Town Complex, 32 Main Street, in the Town of Macedon was called to order by Deputy Supervisor Paul Kenyon at 7:30 p.m.

Mr. Klingler was recognized for his STEM project.  Mr. Klingler helped the students in the STEM program to build a bridge for which a ribbon cutting ceremony will be held on November 11, 2017 at Bullis Park..  From all the students and residents of Macedon we would like to thank him for all his guidance and hard work that he dedicated to this project and the students.

WHEREAS, DB Properties, LLC. Has commenced a proceeding pursuant to Article 7 of the Real Property Tax Law for the year 2017-2018 in Wayne County Supreme Court under index number 81097, and

 

WHEREAS, because the litigation costs of these challenges can be more than the Town can anticipate and afford, and the effects of such litigation extend additionally to the school, village and country tax base, the County of Wayne has adopted a policy of municipal participation in the costs and expense of such litigation by resolution 524-17 date October 17, 2017 and

 

WHEREAS, the Town of Macedon attorney has advised the Town Board that this litigation meets the requirements of municipal participation in that the real property in question has an assessed value in excess of $1,000,000 and the petitioner is desirous of either a change of assessment of ten (10) percent or a change of at least $100,000 less than the assessed value, to wit:  assessment of $1,592,000 is sought to be reduced to $557,000 and

 

WHEREAS, the Town of Macedon attorney has advised the Town Board that this litigation meets the requirements of municipal participation in that the real property in question has an assessed value in excess of $1,000,000 and the petitioner is desirous of either a change of assessment of ten (10) percent or a change of at least $50,000 less than the assessed value, to wit:  assessment of $197,500 is sought to be reduced to $100,000 and

 

WHEREAS, the Town of Macedon, desires to qualify this litigation for Wayne County and Palmyra-Macedon School District participation to equally share the legal and appraisal costs of this litigation,

 

NOW, THEREFOR, BE IT RESOLVED that the Town of Macedon does hereby agree to share equally in the legal and appraisal costs of this litigation and does hereby request Wayne County and Palmyra-Macedon School District participation to share equally in the legal and appraisal costs of this litigation; and

WHEREAS, Evergreen Hills Association , LP has commenced a proceeding pursuant to Article 7 of the Real Property Tax Law for the year 2017-2018 in Wayne County Supreme Court under index number 81118, and

 

WHEREAS, because the litigation costs of these challenges can be more than the Town can anticipate and afford, and the effects of such litigation extend additionally to the school, village and country tax base, the County of Wayne has adopted a policy of municipal participation in the costs and expense of such litigation by resolution 524-17 date October 17,2017 and

 

WHEREAS, the Town of Macedon attorney has advised the Town Board that this litigation meets the requirements of municipal participation in that the real property in question has an assessed value in excess of $1,000,000 and the petitioner is desirous of either a change of assessment of ten (10) percent or a change of at least $100,000 less than the assessed value, to wit:  assessment of $2,876,900 is sought to be reduced to $2,000,000 and

The Town Board desires to establish a water district, known as the “Hamlet of Macedon Water District” (hereinafter the “District”), to continue administering and providing water service to the residents located within the area formerly comprising the Village of Macedon.

v  A resident asked a question regarding the Capital Charges.  The resident spoke to the Comptroller’s office and was informed that a district is to be formed before you can charge it as a water district.  Councilperson Kenyon stated that the Town is not forming a district.  This is for a district that the Town can charge a tax example lighting district, sidewalk district.  What the residents have been charged is a user fee.  If it is a resident based on units and if it is a residence the resident will be charged one unit.  It is then broken down into two parts.  There is an operation and maintenance part and a capital reserve part.  The capital reserve part is what goes toward the bond payments and any maintenance and/or work that the water/sewer will be down the road.

RESOLUTION NO. 288 (2017) GHD CONSULTING SERVICES, INC AGREEMENT

WHEREAS, GHD Consulting Services Inc. (GHD) and Village of Macedon, New York (Owner) entered into an Agreement dated January 28, 2015 for services for Water Main Improvements project; and

 

WHEREAS, the OWNER and GHD previously executed Amendment Nos. 1, 2, 3 and 4 for additional modeling, regulatory approvals, design and construction phase services, and revisions to the terms and conditions; and

 

WHEREAS, the agreement was transferred from the Village of Macedon to the Town of Macedon (OWNER) upon dissolution of the Village effective April 1, 2017; and

 

WHEREAS, the OWNER has requested additional bidding and construction phase services to be provided by GHD; and

 

NOW, THEREFORE, GHD and OWNER agree to amend the Agreement as follows.

 

SCOPE OF SERVICES

Water System Improvements Projects

 

  1. Extended Construction Administration – Additional construction administration budget is required to provide continued services over an extended contract duration due to an extended Contractor installation period, designing and securing the required New York State department of Health approval to decommission the north side water main, and requested additional restoration work.  This effective starting on August 21, 2017 and based on the Contractor’s progress and remain tasks, is anticipated to be through October 31, 2017.
  2. Resident Project Representative – Additional Resident Project Representative (RPR) budget for the anticipated duration of the construction contract based on the extended construction duration.  It is estimated an additional eight weeks of RPR effort is necessary.  Therefore, an allocation of 320 hours of RPR is included.  This is effective starting on August 21, 2017.

a.  Distribute Contract Documents to bidders

b.  Respond to bidder’s requests for information

c.  Review submitted bids and provide recommendations to the Owner.  Assist the Owner in notifying bidders.

 

 

  1. Water Tank Demolition Construction Administration:

a.  Attend a Pre-Construction Meeting with the awarded Contractor to review the scope of work, contract requirements and schedule for the project, and issues minutes for the meeting.

b.  Review shop drawings and for materials to be supplied by the Contractor and other documentation provided by the Contractor.

c.  Review and respond to Contractor’s requests for information.

d.  Organize and attend progress meetings with the Owner, Engineer and Contractor

e.  Prepare a punch list prior to approval stage and acceptance.

f.  Review, negotiate, and provide recommendations to Owner for potential change orders

g.  Review, process, and submit the Contractor’s payment applications to the Owner.

 

  1. Water Tank Demolition Resident Project Representative:

a.  Provide a part-time resident project representative for the work for conformance with the Contract Documents.

b.  Review and respond to Contractor’s requests for information

c.  Observe testing as specified in the Contract Documents

d.  Attend progress meetings with the Owner, Engineer and Contractor

e.  Review, process, and submit the Contractor’s payment applications to the Owner.

 

PROJECT COSTS

The cost of scope items 1,3 and 4 is to be provided on a lump sum basis at a cost of $28,500.

 

The cost of scope items 2 and 5 is to be provided on an hourly basis at a cost not to exceed $36,000.

 

Total Amendment No. 5 cost is $64,000.

 

AUTHORIZATION

The return of one signed copy of this Amendment No. 5, together with a copy of a formal resolution of approval, constitutes acceptance of this Amendment and shall be written authorization for GHD to proceed with the Scope of Service outlined above.  The Town Board authorizes the Supervisor to sign the Amendment No. 5.
