The Regular Meeting of the Town Board of the Town of Macedon held June 26, 2014 at the Town Complex, 32 Main Street, in the Village of Macedon was called to order by Supervisor William H. Hammond at 7:30 p.m.

Jeremiah Shufelt, Town of Macedon Fire Marshall, introduced himself to the Town Board. The Town Supervisor has received positive feedback from the businesses the Fire Marshall has inspected for compliance.

 

RESOLUTION NO. 164 (2014) APPROVAL OF MINUTES

RESOLVED the Board approves the minutes of June 11, 2014 as presented.

CORRESPONDENCE – The Supervisor presented the following:

Amber Young, Account Manager for the American Red Cross informed the Town in an email the Red Cross offers scholarship money to high school or college students.  She can be contacted at Amber.Young2@redcross.org.

 

Thank you to Darlene Virkler for many years of dedicated service as the outgoing Director of the Macedon Public Library and congratulations on her retirement.  The Macedon Public Library has announced the appointment of a new Library Director, Stacey Wicksall effective July 1, 2014.

RESOLVED the Town Board approve the Wayne-Fingers Cooperative Natural Gas Bid (WFL 2015-19) Bid and authorize the Supervisor to sign contract.

RESOLUTION NO. 168 (2014) FIREWORKS DISPLAY PERMIT – ROCHESTER AERO MODELING SOCIETY

RESOLVED the Macedon Town Board approves the Outdoor Fireworks Display Permit as requested by Rochester Aero Modeling Society with Youngs Explosives Corporation as the display company to be held August 30, 2014 at 2529 Macedon Center Road contingent upon Attorney approval of insurance/bond and Macedon Center Fire Department approval. (Town Engineer & Police have approved)

RESOLVED the Town Board accepts the A & P Auto Parts Special Use Permit Modification Request and refers it to the Town of Macedon Planning Board and Wayne County Planning Board.

RESOLUTION NO. 170 (2014) A & P AUTO PARTS SPECIAL USE PERMIT MODIFICATION PUBLIC HEARING SET

RESOLVED the Town Board schedules a public hearing to take public comment on the A&P Auto Parts Special Use Permit Modification, 2384 Creek Road, on August 14, 2014 at 7:35 p.m.

RESOLUTION NO. 171 (2014) POLICE OFFICER RECRUIT

RESOLVED that Brigette Goodfriend be hired as a probationary, part-time Police Officer recruit with sponsorship to attend Phase II training at the Rural Police Training Academy in Batavia, New York.  The rate of pay will be determined by the Chief of Police and the Town Supervisor.

Councilperson Pagano discussed the World Friendship Festival to be held by Macedon Towpath in September 2015.  Discussion followed on the groups from Belgium, Italy, France and more performing on the hill behind the Town Hall. This is a wonderful opportunity for the Town of Macedon.

 

The annual Town of Macedon Ambulance Golf Tournament will be held September 20, 2014.

 

RESOLUTION NO. 172 (2014) SURPLUS EQUIPMENT

RESOLVED the Chief of Police is authorized to declare six (6) Beretta Model 96FS and one (1) Beretta mini Cougar 40 caliber department owned pistols surplus and

 

BE IT FURTHER RESOLVED the Chief is authorized to trade the surplus pistols in with AmChar Wholesale for the purchase of three (3) new Smith & Wesson M&P FS 40 duty pistols.  The trade in value is $200 per Beretta and the purchase of the new M&P 40 are at $410 each, thus no impact on the fiscal 2014 Police budget.

RESOLUTION NO. 173 (2014) FARMLAND PRESERVATION GRANT APPLICATIONS – KOBEY, MERANTE & SMITH

RESOLVED, that the Town of Macedon intends to submit an application for funds, to the NYS Department of Agriculture and Markets farmland protection program and, be it further

 

WHEREAS, the Town of Macedon Comprehensive plan establishes a goal of protecting over 6200 acres of farmland by the use of conservation easements; and

 

WHEREAS, the Town of Macedon has over 2600 acres of farmland under easement and has also secured sufficient funding to protect an additional 194-acres for which the closing documents are being finalized, and

 

WHEREAS, the Town of Macedon invited landowners with agricultural value assessment to an informational meeting to describe conservation easements and the New York State farmland protection program; and

WHEREAS, Kevin Kobey, Vince Merante and Greg Smith have expressed interest in participating in a New York State farmland protection program grant and are willing to utilize a bargain sale of 87.5% of easement value; now therefore be it

 

RESOLVED that the Town of Macedon intends to submit the Kevin Kobey, Vince Merante and Greg Smith farms to the NYS Department of Agriculture and Markets Farmland Protection Implementation Grant Round 13.

 

RESOLVED, that the Town of Macedon intends to submit an application for funds, to the NYS Department of Agriculture and Markets farmland protection program and, be it further

 

RESOLVED, that Supervisor Hammond is authorized and directed to execute on behalf of the Town of Macedon any agreements or documents necessary to implement this resolution on behalf of the Town.

RESOLUTION NO. 174 (2014) EXCAVATOR LEASE/PURCHASE AGREEMENT – FIRST NIAGARA

RESOLVED the lease agreement with First Niagara in the form approved by the Town Attorney be approved by the Town Board and that the Supervisor and Deputy Supervisor be authorized to sign and the term of probable usefulness of the excavator is maximum amount allowed in Section 11 of the Local Finance Law and equipment lease is five (5) years.

RESOLUTION NO. 175 (2014) ASC GRAPHICS FIRST PAYMENT APPROVED

WHEREAS the Town Board approved the ASC Graphics quote to purchase three (3) “Welcome to Macedon Signs” in the amount of $5,024.40 (estimate number 1197)

 

BE IT RESOLVED the Town Board authorizes a payment of fifty percent down payment in the amount of $2,512.20 as requested by ASC Graphics to begin signs to be expensed from A8510.200 (parks).

The Town Attorney received comments back today from the Village of Macedon on the Sewer.

 

RESOLUTION NO. 176 (2014) EXECUTIVE SESSION

RESOLVED the Board enter Executive Session at 8:15 p.m. to discuss pending litigation and a particular personnel matter.

RESOLUTION NO. 178 (2014) HEALTH INSURANCE REIMBURSEMENTS

RESOLVED the Town Board authorize the Town Accountant to pay health insurance reimbursement vouchers numbers 30910 and 30911 for a total amount of $239.50.
