A Regular Meeting of the Town Board of the Town of Macedon held October 11, 2012 at the Macedon Town Hall, 23 West Main Street, Macedon, NY was called to order by Supervisor William Hammond at 7:30 p.m.

Paul Harkness, Ambulance Director met with members of the Village Ambulance and Medical Director regarding mutual aid.  Discussion followed.

 

RESOLUTION NO. 204 (12) AMBULANCE PT APPOINTED – SHEETS

RESOLVED Tom Sheets be appointed part time employee per civil service rules to the position of part time EMT-P provider at a rate of $17.34/hour.

RESOLUTION NO. 205 (12) WAIVE READING OF LEGAL NOTICE

RESOLVED the Town Board waives reading of legal notice published in the Times on September 29, 2012.

This is a continuation of the TJJK Properties LLC Special Use Permit public hearing held August 9, 2012 and reconvened on October 11, 2012.  The application has been before the Planning Board.  Supervisor Hammond asked for any public comments.  Barb and Kevin Heald thanked the Town Board for welcoming them. 

 

RESOLUTION NO. 206 (12) PUBLIC HEARING CLOSED

RESOLVED the Public Hearing be closed at 7:43 p.m.

RESOLUTION NO. 207 (12) TWILIGHT ON THE ERIE SPECIAL USE PERMIT

Whereas, TJJK Properties, LLC made application to the Town of Macedon to obtain Site Plan, Subdivision and Special Use Permits to enable the construction and operation of a camping ground known as Twilight on the Erie RV Resort, at 997 NYS Route 31,

 

And Whereas, the Wayne County Planning Board reviewed the application at their regular meeting on August 29, 2012, and recommended approval of the project subject to several comments as outlined in a letter dated August 31, 2012,

And Whereas, the Town of Macedon Planning Board, acting as Lead Agent in the SEQRA process on the proposal declared a negative declaration at their meeting on 9/10/12, signifying that the project would not have any adverse impacts on the environment,

 

And Whereas, the Town of Macedon Planning Board gave the project Final Site Plan and Subdivision approval at their 9/10/12 meeting,

 

And Whereas, the Town of Macedon Planning recommended that the Town Board approve the Special Use Permit with conditions as specified in a memo dated 10/1/12,

 

And Whereas, the Macedon Town Board did hold a public hearing on the proposed Special Use permit on 8/9/12, and this public hearing was continued on 10/11/12 to obtain public comment,

 

And Whereas, the Macedon Town Board did consider the Town and County Planning Boards’ comments and recommendations relative to the Special Use Permit, and incorporated those comments as appropriate,

 

Now Therefore be it Resolved, that the Macedon Town Board approves the Special Use Permit for TJJK Properties, LLC to operate a Camping Ground facility known as Twilight on the Erie RV Resort, subject to the following conditions:

 

  1. The facility shall be open seasonally from April 15 to October 15.

 

  1. The percentage of seasonal lease sites shall not exceed 40 percent of the total sites on the property.

 

  1. Any caretaker residence constructed as part of the facility shall not be subdivided from the property at a later date, and must be maintained as an integral operating part of the facility.

 

  1. The Twilight on the Erie RV Resort Policy and Operations document, Version I dated October 2012, shall be enforced by the Owners.

 

  1. The Twilight on the Erie RV Resort Seasonal Site Lease document, Version I dated October 2012, including Appendix I, shall be enforced by the Owners.

 

  1. All necessary outside agency approvals, including but not limited to NYSDEC and NYSDOH must be obtained by the Applicant prior to construction.

 

  1. The sewer district extension for this project must be created by the Town Board before the signature of the Planning Board chairman may be affixed to the approved subdivision plan, pursuant to 75-16-C.

 

  1. Permit is effective January 1, 2013 and expires December 31, 2013.

RESOLVED the Town Board referes the Reynolds/McEvoy-Curtain application for an expansion of a non-conforming use for a proposed addition to an existing repair garage.

RESOLVED the Town Board set a public hearing on October 25, 2012 at 8:00 p.m. to hear public comments on an application by Ron Reynolds/Marion McEvoy-Curtain for an expansion of a non-conforming use for a 40’ x 40’ addition to an existing repair garage at 2309 Macedon Center Road.
