A Regular Meeting of the Town Board of the Town of Macedon held June 23, 2011 at the Town Offices, 32 Main Street in the Village of Macedon, was called to order by Supervisor William Hammond at 7:30 P.M.

RESOLUTION NO. 120 (11) APPROVAL OF MINUTES

RESOLVED the Board approves the minutes of June 9, 2011 as presented.

RESOLUTION NO. 121 (11) SPEED REDUCTION REQUEST – CANANDAIGUA RD. SOUTH

RESOLVED the Town Board authorizes the Town Clerk to submit a TE-9 requesting a speed reduction on Canandaigua Road South between the southerly boundary of the existing 40 mph speed limit and extending it southerly to a point south of the curve.

RESOLUTION NO. 123 (11) HIGHWAY LOADER PURCHASE SUBJECT TO PERMISSIVE REFERENDUM

RESOLVED the Highway Superintendent is authorized to purchase a 624K loader on state contract #22063 not to exceed $139,987.99 to be expensed from highway reserve, subject to permissive referendum.

7:45 PM PUBLIC HEARING – SCOTT PEASE SPECIAL PERMIT FOR EXPANSION OF NONCONFORMING USE

 

Scott Pease has applied for an expansion of a preexisting non-conforming use for property located at 590 Frey Road.  Permit would allow applicant to replace existing 14 x 66’ home with a 26 x 50’ home with a garage on land zoned General Commercial.

 

RESOLUTION NO. 124 (11) WAIVE READING OF LEGAL NOTICE

RESOLVED the Town Board waives the reading of the legal notice published in the June 5, 2011 issue of the Times.

One resident spoke in favor of the permit. All comments being heard, the public hearing was closed.

 

RESOLUTION NO. 125 (11) PUBLIC HEARING CLOSED

RESOLVED the Public Hearing be closed at 7:48 p.m.

RESOLUTION NO. 126 (11) PEASE SPECIAL PERMIT FOR EXPANSION OF A NON-CONFORMING USE

WHEREAS a public hearing legal was published in the Times on June 5, 2011, posted on the web site and posted on the Town Clerk’s signboard and

 

WHEREAS the Town of Macedon Planning Board met on June 13, 2011 and gave a positive recommendation

 

WHEREAS a public hearing was held by the Macedon Town Board on June 23, 2011 at 7:45 p.m. at the Macedon Town Hall

 

NOW THEREFORE BE IT RESOLVED the Macedon Town Board approves the Expansion of Non-Conforming Use for Scott Pease to replace existing 14 x 66’ manufactured home with a 26 x 50 home with an additional garage located at 590 Frey Road.

Councilman Maul is looking into a new off-site backup system for small businesses.

 

Chief Colella will be looking into a copier replacement.  The Chief asked Town Attorney Anthony Villani to review enacting a local law to allow enforcement of traffic violations on commercial property.  This will require a letter from business requesting enforcement on their property.

A snowmobile trail proposed by Wayne County was discussed.  An alternate route was suggested.

 

Town Clerk Judy Gravino explained three (3) bills were held for payment and resulted in an additional abstract.  The following breaks the abstracts down as paid.  Totals of the two abstract equal the amount originally approved by the Board on June 6, 2011.

RESOLUTION NO. 127 (11) EXECUTIVE SESSION

RESOLVED the Board enters Executive Session at 8:11 p.m. to discuss litigation.

RESOLUTION NO. 128 (11) OPEN SESSION

RESOLVED the Board returns to Open Session at 9:20 p.m.

It was the consensus to establish summer hours for the town hall during the months of July and August.  The town offices will be open Monday through Thursday from 8 a.m. through 5 p.m.
