A Regular Meeting of the Town Board of the Town of Macedon held February 10, 2011 at the Town Offices, 32 Main Street in the Village of Macedon and 2500 US Highway 27 South, Clermont, Florida was called to order by Supervisor William Hammond at 7:30 p.m.

RESOLVED the Town Board approves the Farmers Market Nutrition Program and authorizes the Supervisor to complete all necessary forms.

Chief Colella updated the Board on the new traffic safety initiative campaign.  Last week 72 traffic tickets were issued with 5 arrests.  All Wayne County Law Enforcement joined together January 31 through February 6, 2011 with “ZERO TOLERANCE” for vehicle and traffic violations that cause driver inattention and unsafe conditions for the motoring public, emergency service workers and police officers.

 

7:45 PM - PUBLIC HEARING SCHEDULED – PROPOSED LOCAL LAW NO. 1-2011 REZONING

The proposed local law would amend the zoning of approximately 79.7 acres of land located on the south side of Macedon Center Road between Scott Road and Walworth Road from AR-40 (Residential) to ORM (Office, Research, & Manufacturing).

 

RESOLUTION NO. 55 (11) WAIVE READING OF LEGAL NOTICE

RESOLVED the reading of the legal notice published in the January 30, 2011 issue of the Times is waived.

Don Lewis, AEY Engineer and owners Mike & Lisa Young were present.  The applicant is proposing to rezone 79.7 acres out of a total of 152.3 acres from AR-40 to ORM for the purposes of constructing a business park.  The road frontage along Macedon Center Road will remain zoned AR-40 with five new single-family homes in this area.

The overall property is adjacent to other lands in ORM zoning, eliminating spot zoning.  Access to public water, electric, natural gas and telecommunication lines is available.  Each lot will have its own septic system.  The lots will be accessed off Macedon Center Road by a dedicated road.

One resident, who was not opposed to the rezoning, had concerns with access in the future if a large facility located there. 

 

Macedon Town Planning Board gave a positive referral with specific site development issues deferred until the application comes before the Planning Board if rezoned.

 

RESOLUTION NO. 56 (11) PUBLIC HEARING CLOSED

RESOLVED the Public Hearing be closed at 8:02 p.m.

The Board will wait until the February 24, 2011 meeting to vote on the proposed local law.

 

RESOLUTION NO. 57 (11) AMBULANCE PER CALL BACKUP SYSTEM

RESOLVED that the EMS Director is authorized to establish a per call backup model to pay drivers, BLS and ALS technicians who respond to and engage in second level calls.  Responders are to be paid through the EMS Staffing Agency at a rate of pay dependent on the type of service provided and to individual qualifications.

Councilman Maul attended the Village Board public hearing on the proposed billboard.  He verified receipt of the Town’s letter listing reasons the Town was not in favor of it.  The Village declared a NEG DEC without including the Town in the environmental process. 

 

The collective bargaining expires with the Macedon Association of Police Officers at the end of this year.  MAPO is in the process of meeting.

 

Palmyra-Macedon Chamber Meeting subject will address county sales tax and school districts.  Some county supervisors do not want to share the sales tax with the schools.  This meeting will be held February 15, 2011 at Parkwood Heights at 6 p.m.

 

Senator Nozzolio responded to the resolution passed by the Town Board opposing property tax caps.  He agreed with the Town’s concerns and has been adamant that any plan to cap property taxes must also include measures to identify and abolish unfunded mandates.

 

Wayne County Board of Supervisors is addressing environmental properties.  Arcadia has requested three parcels to allow the town to apply for a grant to clean up.  In order to apply, the Town must own the properties.  Asbestos removal is not covered by the grant.  Another concern is a junkyard that does not pay the taxes but continues to operate. 

 

Mark Wiener spoke about his assessment with the Board.  The Town Board cannot tell the Assessor how to value properties by law.  Residents would not want a system where the Town Board had that ability.  He met with the Assessor, his assessment was lowered $25,000, went to Grievance, and the next step is small claims or court.
