A Special Meeting of the Town Board of the Town of Macedon held January 13, 2011 at the Town Offices, 32 Main Street in the Village of Macedon and 2599 US Highway 27 South, Clermont, Florida was called to order by Supervisor William H. Hammond at 7:30 p.m.

Norb Miller, Recreation Director presented his report on the Macedon Recreation Program from September 2010 through January 2011.

Chief Colella reported 39 calls for accidents in December.  Officer safety with winter accidents is a serious concern.  They will be working on traffic initiatives for winter driving.  The move over law is now in effect.  Vehicles approaching an accident, flashing lights or highway workers should slow down and move toward the centerline. EMT’s  can now draw blood for DWI’s instead of transporting individuals to the hospital.  This should be in place by February.  A business has donated lockers and benches to the Police Department for the cost of delivery.  The new plastic card gun permits are now being issued at the County Clerk’s Office.

The Town will be closed Monday in honor of Martin Luther King Day.

 

Our new Tax Collector, Lorie Maul is doing a wonderful job.  The new county program has been installed and is working well.  Evening hours have been established and will be reviewed to see if necessary.  The goal is to eventually allow residents to pay their taxes online.

 

RESOLUTION NO. 31 (2011) PUBLIC HEARING SCHEDULED – PROPOSED LOCAL LAW NO. 1-2011 REZONING

RESOLVED the Town Board schedules a public hearing to be held on February 20, 2011 at 7:45 p.m. at the Macedon Town Hall, 32 Main Street, Macedon, NY to hear and consider public comment in regard to rezoning approximately 79.7 acres of land located on the south side of Macedon Center Road between Scott Road and Walworth Road from AR-40 (Residential) to ORM (Office, Research, & Manufacturing).

Milkay Construction has finished the insulation job at the Library.  The weather has prevented completion of the job.

 

Councilman Maul has been updating the web site and adding features.  Residents can access the Town’s web site at macedontown.net.

 

Discussion followed on signage for the Town, Library and Creative Day Care.

 

Town Attorney Anthony Villani updated the Board on the Workers’ Compensation bill received from the County in the amount of $419,000.  A meeting was held with the County Attorney and Administrator.  It was agreed the formula was not ideal, but that nothing could be done about it.  The Town offered to settle on an agreed upon amount by both entities in order to eliminate the County from levying the $419,000 on the town tax bills.  The County would not agree and a law suit was filed on the grounds of violation of state and federal laws by placing said amount on the tax bills.  The County has since asked for an extension of time to answer the complaint.  The Town Attorney agreed to the extension as long as the County did not levy the amount.  Both agreed the Town would pay $69,000 under protest and the payment would be accepted under protest by the County.  This will provide entities involved time to determine the correct premium assessment for 2011 and past years.  Resolution is expected by August.

 

RESOLUTION NO. 32 (2012) WAYNE COUNTY COMPENSATION PAYMENT UNDER PROTEST

RESOLVED the Auditor be authorized to pay $69,000 for the 2011 Wayne County Compensation premium under protest with the understanding the County will accept under protest.

RESOLUTION NO. 33 (2012) MACEDON LAND DEVELOPMENT SETTLEMENT

Upon receipt of first installment payment check from the Town of Walworth regarding Macedon Land Development in the amount of $140,000, the Auditor is authorized to pay $90,000 to Macedon Land Development in full satisfaction and dismissal.

Supervisor Hammond informed the Board that some Town Boards in the county held public hearings and adopted their budgets without including the Workers’ Compensation bill, even though they had the costs back in August/September.  The County added the cost of the Workers’ Compensation on top of their tax rate after it went to the County.

 

Discussion followed on five (5) towns being approved for a long-term grant in the amount of $150,000 to conduct a water study which includes WCIDA money from taxpayers.  The Town of Macedon funded their own studies and creation of their town wide water district.  The cost to install water should be paid by the individual towns and not county wide.

 

RESOLUTION NO. 34 (2011) EXECUTIVE SESSION

RESOLVED the Town Board enters Executive Session at 8:44 p.m. to discuss litigation.
