A Regular Meeting of the Town Board of the Town of Macedon held June 25, 2009 at the Town Offices, 32 Main Street in the Village of Macedon, was called to order by Supervisor William Hammond at 7:30 P.M.

RESOLUTION NO. 176 (09)  EXECUTIVE SESSION

RESOLVED the Board enters Executive Session at 7:31 p.m. to discuss litigation.

RESOLUTION NO. 178 (09) APPROVAL OF MINUTES

RESOLVED the Board approves the minutes of June 11, 2009 with the following amendment:

 

RESOLUTION NO. 164 (09) RT. 31 TRAFFIC REVIEW STUDY

RESOLVED the Town Board authorizes the Town Engineer to hire Bergmann Assoc. not to exceed $3,100 for an independent traffic review of the safety concerns at the following two (2) intersections:

                                    Macedon Parkway & Route 31

                                    Wilson Road & Route 31

And to report back to the Town Board.

Councilman David Maul distributed his comparison of quotes on a microphone system for the meeting room.  The Board will discuss at a later meeting.

 

RESOLUTION NO. 179 (09) MULTI MODAL PROGRAM PROJECT (Turning Lanes & Traffic Signal on Rt. 31)

Authorizing the implementation, and funding in the first instance of the State Multi-Modal Program-aid (and State administered federal program-aid) eligible costs, of a capital project, and appropriating funds therefore.

 

WHEREAS, a Project for the installation of turning lanes and traffic signal on NYS Route 31, P.I.N. 4M349.30A (the Project) is eligible for funding (under Title 23 U.S. Code, as amended, and) New York State’s Multi-Modal Program administered by the NYS Department of Transportation (“NYSDOT”); and

WHEREAS, the Town of Macedon desires to advance the Project by making a commitment of advance funding of the non-local share and funding of the full local share of the costs of the Project; and

 

NOW, THEREFORE, the Macedon Town Board, duly convened does hereby

 

RESOLVE, that the Macedon Town Board hereby approves the above-subject project; and it is hereby further

 

RESOLVED, that the Macedon Town Board hereby authorizes the Town of Macedon to advance 100% of the federal and non-federal share of the cost of 100% work for the Project or portions thereof as are received on behalf of the project; and it is further

 

RESOLVED, that the sum of $300,000 is hereby appropriated from DB5110.202 and made available to cover the cost of participation in the above phase of the Project; and it is further

 

RESOLVED, that since the project has been completed within the above $300,000 budget, it is not necessary for the Town of Macedon to provide that in the event the full federal and non-federal share costs of the project exceeds the amount appropriated above, the Town of Macedon shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the NYSDOT, and it is further

 

RESOLVED, that the Supervisor of the Town of Macedon be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or Multi-Modal Program Funding on behalf of the Town of Macedon with NYSDOT in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality’s first instance funding of project costs and permanent funding of the local share of federal aid and all Project costs that are not so eligible, and it is further

 

RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project, and it is further

 

RESOLVED, that a Certified Copy of this resolution be filed with the Commissioner of Transportation of the State of New York by attaching it to any required and/or appropriate agreements executed in connection with the project between the Town of Macedon and the State of New York; and it is further

 

RESOLVED, that this Resolution shall take effect immediately.

RESOLUTION NO. 180 (09) PUBLIC SAFETY BUILDING CAMERA SYSTEM – ANGEL EYES USA, INC.

BE IT RESOLVED that the Chief of Police is authorized to sign the work order from Angel Eyes USA, Inc., for work on the existing Public Safety Building camera system for a total cost of the work order of $921.50 to be expensed from AF3120.00.

RESOLUTION NO. 181 (09) POLICE – COMPUTER IT HOURS – INTEGRATED SYSTEMS

BE IT RESOLVED that the Supervisor is authorized to execute an agreement with Integrated Systems for the purchase of computer IT hours of service, a (25) hour block at a cost of $2,250 to be expensed from AF3120.00, Integrated Systems is a NYS OGS authorized contractor as stipulated in contract #CMT289A with the stipulation that it reflects an unlimited term of hours and subject to the Town Attorney’s approval.

Chief Colella introduced Officer David Demchuk, who became a certified Police Officer as of June 15, 2009.  Two (2) officers are scheduled for surgery and the Chief has obtained verbal confirmation the part-time officers can temporarily work overtime to fill in the gap.

 

Chief Colella and three (3) other individuals will be participating in Cops on Top Summit for Heroes by climbing Mt. Marcy on June 27, 2009 to honor all officers, nationwide, who have been killed in the line of duty. There will be teams from across the United States participating in the climb to the highest point of all 50 states in remembrance of their fallen comrades.

 

There has been an issue with Hillside Group Home on Farmington Road.  The Police Department and Ambulance were called to Hillside daily for 2-1/2 weeks due to one resident.  Hillside was contacted about correcting the problem, however, the response was not helpful.  The individual is currently in jail.

 

A resident from Mary Drive asked about the Wilson Road and Rt. 31 intersection.  The Town Board has requested NYSDOT consider reducing the speed on Rt. 31 from Brixton Drive to the County Line.  The County and State have acknowledged receipt of the request.  The Town has approved an independent traffic study to help support a request for a traffic light.  He also asked about the condition of the new road due to the ripples.  It is the Town’s understanding the contractor has been asked to mill the road and redo it.  A sensor on the paver was not working properly at the time.

 

Todd Blanchard, Ambulance Director presented his request for staffing proposals received from three (3) companies.  Monroe declined to bid.  Todd recommended Newark Arcadia EMS Staffing Inc., which reflects a savings of $173,000 over last year.  Finger Lakes Ambulance was higher and would require a 30-day written notice to discontinue.  The Board commended Finger Lakes for all their help thus far.  Paul Fera from Arcadia stated they could begin August 3.  Newark Arcadia EMS Staffing Inc. would carry the liability on the staffing.  They will not bill for overtime unless the work was actually performed in Macedon with overtime.  The Board asked for two (2) contracts to help with the budget process.  The first one would cover August through December and the second would be January through December 2010.

 

RESOLUTION NO. 182 (09) AMBULANCE STAFFING – NEWARK ARCADIA EMS STAFFING INC.

RESOLVED the Town Board authorizes the Supervisor to execute the agreement with Newark Arcadia EMS Staffing Inc. for 17 months time period subject to Town Attorney’s approval.

Roundtable:

Councilman Maul – The Recreation Director requested a separate web site for Recreation.  It was the consensus of the Board that Recreation shall use macedontown.net.

 

Councilman Kenyon – Discussed hiring an additional seasonal worker for Highway.

 

RESOLUTION NO. 183 (09) HIGHWAY – SEASONAL WORKER – FIDNER

RESOLVED the Highway Superintendent be allowed to hire Ben Fidner as a Seasonal Worker at the rate of $10.00/hour effective July 6, 2009.

Councilperson Pagano – Information regarding the 31 Corridor and Wayneport Rd Bridge Alternatives Study can be found on the Town Website at www.macedontown.net. Community feedback is welcome.

 

John Celinski of Books Etc. is offering Macedon t-shirts for sale in his shop.

 

The Wayne County Fair is August 10 – 15, which we are all gearing up for.

 

From the Planning Board, an ESL Kiosk will be constructed in Macedon Commons

Plaza on the corner of 31 and Canandaigua Road and also at the corner of

Canandaigua Road and Gananda Parkway.

 

On July 14, 2009 the 11th annual Cycling the Erie Canal Bike Tour, which begins on July

12th for eight (8) days, will stop at Lock 30 in Macedon for a watering station.  This is

a 400-mile route across New York State along the Erie Canal.  Macedon Palmyra

Walworth Chamber of Commerce, Macedon Trails Committee and the Macedon

Fire Department will man the watering stop for the Cyclists at Lock 30.  500 participants

are expected.

 

The Wild’s Family has been asked to name the road they dedicated to the Town next to Midlakes.  The road will be named Marina Parkway and has been submitted to Jim Lee for approval.

 

Highway Superintendent Roets has been working at Bullis Park.  Discussion followed on barriers needed.
