A Regular Meeting of the Town Board of the Town of Macedon held September 9, 2004 at the Town Offices, 32 Main Street, in the Village of Macedon, was called to order by Supervisor William H. Hammond at 7:30 p.m.

RESOLUTION NO. 202 (04) APPROVAL OF MINUTES

RESOLVED the Board approves the minutes of August 26, 2004 with the following corrections: RESOLUTION NO. 197 (04) 1306 MARY DRIVE should call for a hearing (not a public hearing) on September 23, 2004 at 8:00 p.m.

RESOLUTION NO. 204 (04) RESOLUTION OF THE TOWN BOARD OF THE TOWN OF MACEDON, WAYNE COUNTY, NEW YORK (THE "TOWN") TO PROVIDE FOR A PUBLIC REFERENDUM FOR THE APPROVAL OF A RESOLUTION CONCERNING TOWN OF MACEDON POLICE HOUSING.

At a regular meeting of the Macedon Town Board of the Town of Macedon, Wayne County, New York, held at the Town Hall, 32 Main Street, in the Town of Macedon, New York on the 25th day of August, at 7:30 p.m., there were present:

Absent: Councilperson Paul Kenyon

The following Resolution was offered by Councilperson Nawrocki and moved its adoption:

Shall the Town of Macedon be authorized to expend seven thousand five hundred

dollars ($7,500) to continue the lease of the property located at 96-98 Main Street,

Macedon, New York to house a town-wide Police Department?

Seconded by Councilperson Maul, and duly put to a vote, which resulted as follows:

The resolution was thereupon declared duly adopted.

The following Resolution was offered by Supervisor Hammond and moved its adoption:

POLICE HOUSING REFERENDUM ON NOVEMBER ELECTION

The aforesaid proposition shall be subject to the voters of the Town of Macedon

at the next General Election to be held on November 2, 2004. All electors of the

Town of Macedon qualified to vote at the aforesaid General Election by the

Wayne County Board of Election shall be qualified to vote upon this proposition.

The Town Clerk and the Town Attorney are hereby directed to take all

appropriate steps to have the proposition submitted at the next general election.

Seconded by Councilperson Nawrocki, and duly put to a vote, which resulted as follows:

WHEREAS, the Town Board adopted the form of the proposition for the approval at said meeting; and

WHEREAS, it is now desired to submit the proposition for approval at the General Election and to provide for the notice of such referendum and such other matters in connection therewith; and

WHEREAS, the matter having been fully discussed by all members of the Town Board:

NOW, THEREFORE, BE IT RESOLVED THAT:

  1. That a special referendum of qualified electors of the Town of Macedon, Wayne County, New York, shall be held on Tuesday, November 2, 2004 for the purpose of submitting a proposition for the approval of the Town of Macedon Town-Wide Police Housing described above adopted by the Town Board on August 25, 2004. The place of the holding of such referendum shall be at:

Election District Polling Place

    1. Macedon Center Fire Department, 2481 Canandaigua Road
    2. Macedon Center Fire Department, 2481 Canandaigua Road
    3. Town of Macedon Community Room (Library), 30 Main Street
    4. Town of Macedon Community Room (Library), 30 Main Street
    5. Town of Macedon Meeting Room (Town Hall), 32 Main Street

The polls for such referendum shall be kept open for the purpose of voting on such proposition between the hours of 6:00 a.m. and 9:00 p.m., prevailing time, at such polling site. The proposition to be submitted at general election shall be in substantially the form hereinafter set forth in the form of notice of such referendum.

  1. The Town Clerk is hereby authorized and directed to give notice of said special referendum by publication of a notice once in the official newspaper of the Town, said publication to be made at least ten days prior to the date of said special referendum. In addition, the Town Clerk shall cause a copy of such notice to be posted on the bulletin board of the Town maintained pursuant to subdivision six of section thirty of Town Law at least 10 days before the date of said special referendum. Such notice shall be in substantially the following form, to-wit:

NOTICE IS HEREBY GIVEN that a special Town referendum in and for the Town of Macedon, Wayne County, New York will be held on Tuesday, November 2, 2004 at:

At which the polls will remain open for the purpose of voting between the hours of 6:00 a.m. and 9:00 p.m., prevailing time, for the purpose of submitting the following described proposition for the approval of the qualified electors of said Town:

PROPOSITION

Shall the Resolution adopted by the Town Board of the Town of Macedon, New York dated August 25, 2004 to expend seven thousand five hundred dollars ($7,500) to continue the lease of the property located at 96-98 Main Street, Macedon, New York to house a town-wide Police Department be approved?

Any person qualified to vote at a general Town election may vote upon the proposition to be submitted to the aforesaid general election.

That this Resolution shall take effect immediately.

Town of Macedon

The Library has set a tentative date to hold an open house to review the work that has been done relating to the Bullis Collection on October 21, 2004 from 6-8 p.m.

Chief Ellis explained the Buckle Up New York Program to the Town Board. Grant money pays the officer's overtime to enforce the seat belt law for the expanded effort campaign over and above the routine checks. The Town receives $10 back for each traffic citation in its jurisdiction where a fine is assessed.

Attorney Anthony Villani updated the Town Board on the Wayne County Solid Waste Program issue and the weighted vote system in the County.

RESOLUTION NO. 205 (04) HILTON, JOZWIAK, MARVIN & STANTON AGRICULTURALL CONSERVATION GRANT EASEMENT EXTENSION

RESOLVED to authorize the Supervisor to apply for a one- (1) year extension on the federal portion of the agricultural conservation grant easement for Hilton, Jozwiak, Marvin and Stanton.
