A Regular Meeting of the Town Board of the Town of Macedon held February 26, 2004 at the Town Offices, 32 Main Street, in the Village of Macedon, was called to order by Supervisor William H. Hammond at 7:30 p.m.

RESOLUTION NO. 70 (04) APPROVAL OF MINUTES

RESOLVED that the Board approves the minutes of February 12, 2004 with the following amendments:

Motion labeled "RESOLUTION NO. 59 (04)" be rescinded

Amend RESOLUTION NO. 66 (04) to reflect the local law passed as

originally presented – based on petition of the involved owners,

And in addition: Laker made the affirmative representations to the Town Board

that Laker had the permission of the landowners to make the zoning application.

RESOLUTION NO. 72 (04) HIGHWAY TRACTOR/LAWN MOWER/PLOW AD

RESOLVED to authorize the Highway Superintendent to solicit bids for a tractor/lawn mower/plow per the specifications to be submitted by the Highway Superintendent.

RESOLUTION NO. 73 (04) HARWOOD LANE DEDICATION

RESOLVED that consent be and the same hereby is given to the Town Superintendent of Highways of the Town of Macedon to make an Order laying out the lands for dedication of Harwood Lane in Parkwood Heights Subdivision.

RESOLUTION NO. 74 (04) HARWOOD LANE SANITARY SEWER, STORM

SEWER, WATER & TURNAROUND

RESOLVED the Town Board accepts the grant of the easement along Harwood Lane for sanitary sewer, storm sewer, water and turnaround.

It was the consensus of the Board to allow the Girl Scouts of the Three Sister’s Service Unit to use the Town of Macedon Library and Community Room on Friday, March 19, 2004 overnight. The Town’s insurance agent has been contacted and the usage is covered.

A discussion followed on security cameras. Supervisor Hammond will check on remaining building funds and grants available.

Jim Beckenbach, Empire Auto Salvage located at 2384 Creek Road, requested the Town Board accept a contract for clean up of the property in place of the $50,000 bond due to Kemper canceling.

RESOLUTION NO. 75 (04) EMPIRE AUTO SALVAGE CLEAN UP CONTRACT

RESOLVED that the Town Board amends RESOLUTION 337 (00) Item 14 Paragraph #2 so that the referenced bond is replaced by a current contract maintained on file with the Town Clerk.

Supervisor Hammond and Councilperson Maul will be meeting at the Village Police Office February 27, 2004 at 2:00 p.m. to discuss Police issues. Mayor Hoteling has proposed to bill the Town 75% of the actual charges each month and will provide the monthly financial report for the Police Dept.

Thank you to Anna Shearer for the beautiful mural in the conference room. And a special thanks goes to the Macedon Center Fire Dept. and Jay Harding for making it possible.

CORRESPONDENCE – The Supervisor presented the following:

A no passing zone will be installed by NYSDOT at the intersection of Route 350 at O’Neil Road. It will restrict passing 400 feet north and 400 feet south of O’Neil Road for vehicles approaching the intersection. This will be initiated as soon as the weather allows.

John Carpenter with Senator Nozzolio’s Office notified the Supervisor that the traffic light study at Yellow Mills and Route 31 would be completed this spring. The study has been on hold due to the construction in Palmyra, which would have affected the results.

The 2004 Crop Walk will be held on Sunday, May 2, 2004. Current insurance coverage will be submitted in early April.

NYS Office of the State Comptroller provided average estimated cost thresholds for determining whether approval of the State Comptroller is necessary for certain special district actions in the year 2004.

ALUF Plastics provided a listing of positions available. ALUF is a canliner manufacturer located in Blauvelt, New York.

Supervisor Hammond has scheduled a meeting on March 17, 2004 with the Greater Rochester Enterprise at the Town Hall at 4:30 p.m. regarding ongoing economic development.

Supervisor Hammond has received a quote from Charles Kemp with True North Tractor for a Toro snow blower. The Board will discuss at the next meeting.

ROUND TABLE

Councilperson McEwen – Inez Thompson has resigned from the Library Board. The Library Board can appoint to fill the unexpired term. Volunteers will open the Library at 10:00 a.m., 6 days a week, April through September. There is an ongoing problem with humidity in the Bullis Room. Supervisor Hammond is working on the problem.

Councilperson Kenyon thanked the Villani Law Office and the Macedon Police for their efforts during recent events.

Councilperson Nawrocki discussed the copier/printer proposal. Brian Stevens will assess

the office needs.

RESOLUTION NO. 76 (04) EXECUTIVE SESSION

RESOLVED the Board enters into Executive Session at 8:43 p.m. to discuss litigation.
