ZONING BOARD OF APPEALS

December 18, 2019

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, December 18, 2019, at the Town Complex, 32 Main Street, Macedon, NY Present were Chairman Warren Jeffries, members Mike Mosher, Ronald Santovito, Brian Frey, and Deborah McEwen.  Also present was Board Clerk Brandi Schutt. Absent were Town Engineer/CEO Scott Allen and Town Councilman Bruce Babcock.

 

Chairman Jeffries called the meeting to order at 7:28 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times of Wayne County Newspaper.

 

PUBLIC HEARING:

 

Z-08-19 – Vega – 240 Route 31– Area Variance – Section 135-62-B – A nonconforming building shall not be enlarged, extended or increased – Colin Vega was present to address the board. He explained that he would like to purchase the old Cowlick Ice Cream shop and turn it into a fitness center. He explained that they want to tear down the back half of the building and rebuild a 30’X40’ addition. He also mentioned that he would be purposing to connect to the sewer. He stated that there is a shared driveway easement with the property behind the building.

 

Margaret Brooks was present to speak in favor of the application.

 

Steven Nardozzi was present to speak against the application. He is part ownership of the barn that shares a driveway with the property being discussed. He read a letter he previously submitted to the board concerning the driveway easement and questions that were improperly marked on the SEQR that was submitted.

 

David Masciangelo was also present to speak against the application.  He expressed his concern for too much traffic for his apartment building next door.

 

John Nardozzi was also present to speak against the application. He is partners with Steven Nardozzi at the barn.

                         

•        Wayne County Planning Board – Positive referral under the conditions that the minimum variance necessary should be considered and no structure addition should be constructed closer to Route 31 than already exists

•        Planning Board – Positive referral for the concept subject to demonstrating conformance with the underlying access easements and proof of adequate parking

•        Town Board – No Comment

•        SEQR – Submitted

 

No one else was present to speak in favor or against the granting of these variances.  The public hearing was closed at 8:07 p.m.  

 

BOARD DISCUSSION:

 

Z-08-19 – Vega – 240 Route 31– Area Variance – Section 135-62-B – A nonconforming building shall not be enlarged, extended or increased – The applicant’s attorney Anthony Scalia was present to address the letter Mr. Nardozzi submitted to the board. He explained that a few of the questions answered on the SEQR were an oversight and that they would be amending the form. He also explained that the driveway easement is a private agreement and that it is not an appropriate discussion at the zoning board but rather the courts.

 

The board decided to table the application until the January 15th meeting with a special meeting being held on January 7th.

A motion to approve the 9-18-19 minutes was made by Brian Frey, seconded by Ronald Santovito.  All in favor; minutes approved.
