ZONING BOARD OF APPEALS

September 16, 2015

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, September 16, 2015, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and Board members Carl Eligh, Brian Frey, Anthony Rosati and Ronald Santovito.  Also present was Board Clerk Susan Bush.  Absent were Town Councilwoman Sandy Pagano and Town Engineer/CEO Scott Allen.

 

Chairman Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-07-15 – Freeland – 1297 Yellow Mills Road – Area Variance – Sections 135 Schedule I & 135-162-B – Front setback for garage addition & expansion of non-conforming building – Harold Freeland and Rochelle Freeland were present to explain this application.  Ms. Freeland explained that her father, who has a disability, cannot park his car in the existing garage.  Putting an extension on the front of the garage would allow him to park inside and have easier access into his home.  She also noted that a neighbor’s house is closer to the road than the proposed addition would be.

 

·        Planning Board – Positive referral

·        Wayne County Planning Board – Returned to the Town to be handled as a local matter

·        Town Board – Representative absent

·        SEQR – Not required at Appeals level

 

There was no one else to speak for or against the granting of these variances.  The public hearing was closed at 7:49 p.m.

 

BOARD DISCUSSION:

 

Z-07-15 – Freeland – 1297 Yellow Mills Road – Area Variance – Sections 135 Schedule I & 135-162-B – Front setback for garage addition & expansion of non-conforming building – A motion was made by Carl Eligh, seconded by Tony Rosati, to grant these variances as submitted in the application.

 

The Board discussed that this type of variance had been granted in the past; this is a pre-existing, non-conforming house/lot; and, the neighbor’s house sits much closer to the road.

 

The five factors were reviewed:  There would be no undesirable change in the character of the neighborhood; benefit sought could not be achieved by another method other than a variance; variance requested was not substantial; there would be no adverse impact on the physical or environmental conditions in the neighborhood; difficulty was self-created.

 

Roll Vote:  Eligh – yes; Frey – yes; Rosati – yes; Santovito – yes; Jeffries – yes.  Therefore, these variances are granted.

 

MINUTES:

 

A motion to approve the 08-19-15 minutes was made by Ron Santovito, seconded by Tony Rosati.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by Brian Frey, seconded by Carl Eligh.  All in favor; meeting adjourned at 7:55 p.m.
