ZONING BOARD OF APPEALS

June 18, 2014

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, June 18, 2014, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Carl Eligh, Brian Frey, John Gravino and Ronald Santovito.  Also present were Councilwoman Sandy Pagano and Board Clerk Susan Bush.  Absent was Town Engineer/CEO Scott Allen.

 

Chairman Jeffries called the meeting to order at 7:28 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-05-14 – NMM, LLC – 1503 Canandaigua Road/Route 31 (Macedon Commons Plaza) – Area Variance – Section 135-191-A – Size & height of sign – Applicant Ted Filer of NMM, LLC was present to address the Board.  He provided the Board members with additional illustrations showing the proposed sign vs. the existing sign.  The existing sign (22 yrs. old) can only hold five (5) tenant panels.  At present there are nine (9) tenant spaces in the plaza plus four (4) on outparcels and another for a vacant lot.  The new sign could accommodate all of these.  Mr. Filer stated this would be a refurbishment of the existing sign.  Plaza identification, tenant panels and lighting would be replaced.  The width of the sign would not change, but the height would increase by 4 ft.  The new sign would not be as tall as the Walmart or Filer’s PowerSports signs.  Sign would be internally lit, as at present.

 

A Macedon resident spoke in favor of the request.  However, he questioned the possibility of vehicles skidding into the sign as they entered the plaza from Route 31.  Mr. Filer responded that in the 2-1/2 years he has owned the plaza, he was not aware of that happening.  The only incident had been an 18-wheel truck which should not have used that entrance and became hung up on the curbing.

 

·        Wayne County Planning Board – Returned to the Town to be handled as a local matter

·        Planning Board – Positive recommendation

·        Town Board – Representative felt this business was a positive resource in the community

·        SEQR – Not required at Appeals level

 

There was no one else present to speak for or against the granting of these variances.

 

BOARD DISCUSSION:

 

Z-05-14 – NMM, LLC – 1503 Canandaigua Road/Route 31 (Macedon Commons Plaza) – Area Variance - Section 135-191-A – Size & height of sign – A motion was made by Carl Eligh, seconded by Brian Frey, to grant these variances as submitted in the application.  Board members felt this would not change things at the plaza; the sign would have the same footprint as at present; a new sign would be good for future business.

 

The five factors were reviewed:  There would be no undesirable change in the character of the neighborhood; the benefit sought could not be achieved by some method other than a variance; variance requested is not substantial; there would be no adverse physical or environmental effects; difficulty was self-created.

 

Roll Vote:  Eligh – yes; Frey – yes; Gravino – yes; Santovito – yes; Jeffries – yes.  Therefore, these variances are granted.

 

MINUTES:

 

A motion to approve the 05-21-14 minutes was made by Ron Santovito, seconded by John Gravino.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by John Gravino, seconded by Carl Eligh.  All in favor; meeting adjourned at 7:50 p.m.
