ZONING BOARD OF APPEALS

January 15, 2014

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, January 15, 2014, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Carl Eligh, John Gravino and Ronald Santovito.  Also present were Town Councilwoman Sandy Pagano and Board Clerk Susan Bush.  Absent was Town Engineer/CEO Scott Allen.

 

Chairman Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which the Board serves.

 

It was noted that Board member Aaron Cook had resigned his seat as of 12-19-13 due to relocation outside the Town of Macedon.

 

 

BOARD DISCUSSION:

 

Z-12-13 – Zaretsky – 1035 Mayflower Drive – Area Variance – Section 135-162-B – Expansion of a non-conforming building & Section 135 Schedule I – Side & front setbacks for residential addition – Prior to discussion, Chairman Jeffries reminded everyone that the Public Hearing for this application had been completed on 12-18-13.  A motion was made by Carl Eligh, seconded by John Gravino, to grant these variances per the application (Z-12-13).

 

Mr. Gravino felt this project did not fit with the neighborhood and would not be appropriate even with the modifications made from the previous submission.  Mr. Santovito felt the requested variances for the front and side setbacks were substantial and did not fit the character of the neighborhood.  He also felt that due to the lot size, any change in the footprint of the building would have a large impact.  Mr. Eligh had researched similar past requests and noted that only in two (2) cases had there been side setbacks granted for less than 10 ft.  In those cases there were extenuating circumstances such as lot topography, septic system location or no existing garage, and he did not feel there were extenuating circumstances in this case.  He also questioned the drainage situation between the houses at 1025 and 1035 Mayflower Drive.

 

The five factors were reviewed:  There would be an undesirable change in the character of the neighborhood or a detriment to nearby properties; benefit sought could not be achieved by other than a variance; requested variances were substantial; proposed variances would have an adverse impact on the physical or environmental conditions in the neighborhood; difficulty was self-created.

 

Roll Vote:  Eligh – no; Gravino – no; Santovito – no; Jeffries – no; therefore, these variances are denied.

 

 

MINUTES:

 

A motion to approve the 12-18-13 minutes was made by Carl Eligh, seconded by Warren Jeffries.  All in favor; minutes approved.

A motion to adjourn the meeting was made by John Gravino, seconded by Carl Eligh.  All in favor; meeting adjourned at 7:55 p.m.
