ZONING BOARD OF APPEALS

August 21, 2013

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, August 21, 2013, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Aaron Cook, Carl Eligh and Ronald Santovito.  Also present was Board Clerk Susan Bush.  Absent were John Gravino, Councilwoman Sandy Pagano and Town Engineer/CEO Scott Allen.

 

Chairman Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-08-13 – Gascon – 3272 Hance Road – Area Variance – Section 135-162-B – Expansion of a non-conforming building – Christian Gascon was present to address the Board regarding this application.  The Gascons have an older home which does not have a garage.  They would like to build an addition containing a 3-car garage and additional living space for their growing family.  Their house is considered non-conforming because the front setback is less than required by the current Code.  The addition will be two stories, including a 3-car garage and approximately 1,100 sq. ft. of living space.  The front of the addition will align with the front of the house.  The addition will be for personal use only; no commercial use will be made of the space.

 

·        Planning Board – Positive referral

·        Wayne County Planning Board – Recommended approval

·        Town Board – No comment

·        SEQR – Not required at Appeals level

·        Town of Walworth – Referral made due to project location  – No response

 

There was no one else present to speak for or against the granting of this variance.

 

BOARD DISCUSSION:

 

Z-08-13 – Gascon – 3272 Hance Road – Area Variance – Section 135-162-B – Expansion of a non-conforming building – A motion was made by Ron Santovito, seconded by Aaron Cook, to grant the variance as submitted.  Board members noted this is an older home which the owners were seeking to improve.

 

The five factors were reviewed:  No undesirable change in the character of the neighborhood (could be considered an improvement); no other method to achieve the desired result; variance is substantial; no adverse physical or environmental impact; difficulty was self created.

 

Roll Vote:  Cook – yes; Eligh – yes; Gravino – absent; Santovito – yes; Jeffries – yes; therefore, this variance is granted.

 

 

 

MINUTES:

 

A motion to approve the 07-17-13 minutes was made by Carl Eligh, seconded by Ron Santovito.  All in favor (Gravino absent); minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn was made by Aaron Cook, seconded by Carl Eligh.  All in favor (Gravino absent); meeting adjourned at 7:48 p.m.
