ZONING BOARD OF APPEALS

July 17, 2013

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, July 17, 2013, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Aaron Cook, Carl Eligh, John Gravino and Ronald Santovito.  Also present were Town Councilwoman Sandy Pagano and Board Clerk Susan Bush.  Absent was Town Engineer/CEO Scott Allen.

 

Chairman Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-07-13 – Samuelson – 975 Wayneport Road – Area Variance – Section 135-61-B-5 – Accessory structure in front yard – David Samuelson was present to address the Board regarding his request to build a pole barn in his “front” yard.  Mr. Samuelson has a 3.75 acre corner lot (Wayneport & Wilkinson Roads) and would like to build a 24 ft. x 24 ft. pole barn behind his house.  The house faces Wayneport Road with the driveway on Wilkinson Road.  Because this is a corner lot, there is no “rear” yard, and a variance is required.  The applicant would like to locate the barn approximately 9 ft. forward of the Wilkinson Road end of his house.  Mr. Samuelson presented the Board with supporting information detailing the reasons why the proposed location was necessary:  1) Steep terracing of the property; 2) Avoid blocking view from house windows; 3) Septic system location; 4) Existing shed deteriorating & need for additional storage space for vehicles & lawn equipment; 5) Barn would be 80 ft. from Wilkinson Rd.; 6) Existing garage (under house) cannot accommodate one of his vehicles.  The barn would be 6-8 ft. from the house with a man door on the side toward the house; barn would not be visible from Wayneport Road due to the elevation drop.  A Board member asked if building a garage addition to the house had been considered.  Mr. Samuelson stated he had considered that option but it would be much more expensive.

 

A neighbor from 387 Wilkinson Road was present to speak.  He questioned the required distance between the house and the barn, but overall was in favor of the requested variance.

 

·        Planning Board – Recommended the placement of the barn be in line with the Wilkinson

Road end of the house

·        Wayne County Planning Board – Referral not required

·        SEQR – Not required at Appeals level

·        Town Board – No comment

 

There was no one else present to speak for or against the granting of this variance.

 

BOARD DISCUSSION:

 

Z-07-13 – Samuelson – 975 Wayneport Road – Area Variance – Section 135-61-B-5 – Accessory structure in front yard – A motion was made by John Gravino, seconded by Carl Eligh, to grant the variance as submitted.  Board members questioned the separation needed between the barn and the residence for safety purposes.  It was noted that the required distance would be reviewed as part of the building permit process if the variance was granted.  Board members discussed the fact that the barn would not be visible from Wayneport Road and that it would be more than the required 60 ft. front setback from Wilkinson Road.

 

The five factors were reviewed:  No undesirable change in the character of the neighborhood; benefit could not be achieved by another method; variance requested is not substantial; no adverse physical or environmental impact; difficulty was self created.

 

Roll Vote:  Cook – yes; Eligh – yes; Gravino – yes; Santovito – yes; Jeffries – yes; therefore, this variance is granted.

 

MINUTES:

 

A motion to approve the 06-19-13 minutes was made by John Gravino, seconded by Aaron Cook.  All in favor; minutes approved.

A motion to adjourn was made by John Gravino, seconded by Carl Eligh.  All in favor; meeting adjourned at 8:02 p.m.
