ZONING BOARD OF APPEALS

November 16, 2011

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, November 16, 2011, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries, members Aaron Cook, Carl Eligh, John Gravino and Ronald Santovito.  Also present were Town Councilwoman Sandy Pagano, Code Enforcement Officer Aron Thompson and Board Clerk Susan Bush.

 

Prior to the start of the meeting, Code Enforcement Officer Aron Thompson was introduced to the Board members.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-08-11 – Croce – 1186 Wilson Road – Area Variance – Section 135-61-B-1 – Third accessory structure & Section 135-61-B-3 – Accessory structure larger than residence – Elio Croce was present to explain his application.  His property is 26+ acres with a residence, detached garage & another small outbuilding.  He would like to construct a 30’ x 48’ pole barn to store personal items and vehicles (boat, trucks, lawnmower, etc.) and have a woodworking shop.  His home & garage were built in the late 1940’s or early 50’s, and the doors on the garage do not accommodate all of his vehicles.  Currently, these vehicles are parked outside.  Barn would not be used for any commercial purpose.

  • SEQR – Not required at Appeals level

 

There was no one else present to speak for or against the granting of these variances.

 

BOARD DISCUSSION:

 

Z-08-11 – Croce – 1186 Wilson Road – Area Variance – Section 135-61-B-1 – Third accessory structure & Section 135-61-B-3 – Accessory structure larger than residence – A motion to grant these variances per plans submitted was made by Carl Eligh, seconded by Aaron Cook.  Board members noted this is a large parcel of land (26+ acres); the property predates the zoning code; and similar variances have been granted in this neighborhood.

 

The five factors were reviewed:  No undesirable change in the neighborhood; benefit sought could be achieved through another method; variance was substantial; no adverse effect on the physical or environmental conditions of the neighborhood (could be considered an improvement by storing vehicles & equipment inside); difficulty was self-created.

 

Roll Vote:  Cook – yes; Eligh – yes; Gravino – yes; Santovito – yes; Jeffries – yes.  Therefore, these variances are granted.

 

MINUTES:

 

A motion to approve the 08-17-11 minutes was made by Aaron Cook, seconded by Carl Eligh.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by John Gravino, seconded by Carl Eligh.  All in favor; meeting adjourned at 7:42 p.m.
