ZONING BOARD OF APPEALS

May 19, 2010

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday,

May 19, 2010, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries, members Aaron Cook, Carl Eligh and John Gravino.  Also present was Board Clerk Susan Bush.  Absent were Ronald Santovito, Town Councilwoman Sandy Pagano and Code Enforcement Officer Michael Nelson.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

Aaron Cook was welcomed as the new Board member.

 

PUBLIC HEARINGS:

 

Z-02-10 – Johnson – 2894 Daansen Road – Area Variance – Section 135-61-B-5 – Shed located in front yard – David Johnson was present to explain his application.  He would like to put a 10’ x 16’ storage shed at the end of his driveway turnaround.  This location would meet the side and front setbacks required; however, it would be forward of the house’s front line necessitating a variance.  Mr. Johnson then explained to the Board that his options are limited by underground drainage tiles, drainage swales, a raised absorption bed for his septic system and a sharp drop off in the rear yard.  The shed would be placed perpendicular to his house, facing the driveway.

 

·        Wayne County Planning Board – Referral not required

·        Planning Board – Would prefer to see shed placed in rear yard in

compliance with Town Code

·        Town Board – Representative absent

·        SEQR – Not required at Appeals level

 

There was no one else present to speak for or against the granting of this variance.

 

Z-03-10 – Sacco – 2260 West Walworth Road – Area Variance – Section 135 Sched. I (Attach. 1) – Front setback for porch addition – Timothy and Dawn Sacco were present to explain their application.  They have no covered entry to their house and would like to build a porch across the entire front of their house (30’).  The front setback for the house is currently 64+ ft., and the proposed porch would be 8’ deep, requiring a 4 ft. variance.

 

  • Wayne County Planning Board – Referral returned to the Town to be handled

as a local matter

  • Planning Board – No concerns with this application
  • Town Board – Representative absent
  • SEQR – Not required at Appeals level

 

There was no one else present to speak for or against the granting of this variance.

 

BOARD DISCUSSION:

 

Z-02-10 – Johnson – 2894 Daansen Road – Area Variance – Section 135-61-B-5 – Shed located in front yard – A motion to grant this variance as submitted was made by Carl Eligh, seconded by John Gravino.  This house is 115± ft. from the road.  Space in the back yard is very limited due to the septic absorption beds and sharp drop off.  Board members noted that this variance has been granted in the past.

 

The five factors were reviewed:  No undesirable change in the neighborhood; benefit sought by applicant could not be accomplished by another method; variance could be considered substantial; no adverse environmental impact.

 

Roll Vote:  Cook – yes; Eligh – yes; Gravino – yes; Santovito – absent; Jeffries – yes.  Therefore, this variance is granted.

 

Z-03-10 – Sacco – 2260 West Walworth Road – Area Variance – Section 135 Sched. I (Attach. 1) – Front setback for porch addition – A motion to grant this variance as submitted was made by John Gravino, seconded by Aaron Cook.  Board members felt this variance was minor in nature and has been granted before.

 

The five factors were reviewed:  No undesirable change in the neighborhood; variance was not substantial; no adverse environmental impact.

 

Roll Vote:  Cook – yes; Eligh – yes; Gravino – yes; Santovito – absent; Jeffries – yes.  Therefore, this variance is granted.

 

MINUTES:

 

A motion to approve the 02-17-10 minutes was made by John Gravino, seconded by Carl Eligh.  All in favor; motion carried.

 

ADJOURNMENT:

 

A motion to adjourn was made by John Gravino, seconded by Aaron Cook.  All in favor; meeting adjourned at 8:05 p.m.
