ZONING BOARD OF APPEALS

November 19, 2008

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, November 19, 2008, at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries, members Carl Eligh, John Gravino, Charles Packard and Ronald Santovito.  Also present were Town Councilman David McEwen, Code Enforcement Officer Michael Nelson and Board Clerk Susan Bush.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

 

PUBLIC HEARING:

 

Z-08-08 – Heckman – 1821 Walworth Road – Area Variance – Sections 135 Schedule I & 135-162-B – Front & side setbacks for garage addition – Applicants Thomas & Catherine Heckman were present to explain their request.  They currently do not have a garage and would like to add a breezeway (10 ft. x 20 ft.) and two-car garage (22 ft. x 24 ft.) to their home.  Garage will be used for storage of personal vehicles and items; no commercial use will be made of the space.  This addition will result in a 10 ft. side setback and continuation of the non-conforming 55 ft. front setback.  At the time of construction, residence met applicable requirements; however, subsequent Code changes now dictate a variance for the front setback.  A similar variance (breezeway & garage) was granted for the adjoining neighbor at 1825 Walworth Road. 

 

·        Planning Board – Positive referral

·        Town Board – Concurred with Planning Board recommendation

·        Wayne County Planning Board – No intermunicipal or countywide

impact; returned to the Town to be handled as a local matter.

·        SEQR – Not required at Appeals level

 

There was no one else present to speak for or against the granting of these variances.

 

 

BOARD DISCUSSION:

 

Z-08-08 – Heckman – 1821 Walworth Road – Area Variance – Sections 135 Schedule I & 135-162-B – Front & side setbacks for garage addition – A motion to grant these variances as submitted was made by Carl Eligh, seconded by John Gravino.  Members recognized the same variances had been granted for the adjoining property.  The five factors were reviewed.  Members felt it would not change the character nor have an adverse impact on the neighborhood.

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes.  Therefore, these variances are granted.

 

 

MINUTES:

 

A motion to approve the 09-17-08 minutes was made by John Gravino, seconded by Ron Santovito.  All in favor; minutes approved.

 

 

ADJOURNMENT:

 

A motion to adjourn was made by John Gravino, seconded by Ron Santovito.  All in favor; meeting adjourned at 7:55 p.m.
