ZONING BOARD OF APPEALS

December 19, 2007

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, December 19, 2007, at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Carl Eligh, Charles Packard and Ronald Santovito.  Also present were Councilman David McEwen and Board Clerk Susan Bush.  Absent were John Gravino and Code Enforcement Officer Michael Nelson.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

 

PUBLIC HEARING:

 

Z-18-07 – Reamein2067 Eddy Road – Area Variance – Section 135 Schedule I (Attachment 1) – Front setback for porch – Jim Walsh, contractor representing the homeowner, was present to explain the application.  This is the rebuild of a fire-damaged house, which originally had a concrete front stoop.  The homeowner would like to replace the concrete stoop with a full porch.  This would also allow them to reconfigure the interior of the home, providing more living space.  Approximately half of the porch would encroach on the front setback to a maximum of 4 ft.  Mr. Walsh stated the neighbors appear to be in favor of the project.

 

·        Planning Board – Board gave a positive referral.

·        Town Board – Concurred with the Planning Board.

·        Wayne County Planning Board – Referral not required.

·        SEQR – Not required at Appeals level.

 

There was no one else present to speak for or against the granting of this variance.

 

 

BOARD DISCUSSION:

 

Z-18-07 – Reamein – 2067 Eddy Road – Area Variance – Section 135 Schedule I (Attachment 1) – Front setback for porch – A motion was made by Carl Eligh, seconded by Charles Packard, to grant this front setback variance as submitted.  Board members felt this was not a significant variance, and the addition of the porch would improve the character of the home and neighborhood.  The five factors were reviewed.

 

Roll Vote:  Eligh – yes; Gravino – absent; Packard – yes; Santovito – yes; Jeffries – yes; Therefore, this variance is granted.

 

 

 

MINUTES:

 

The 10-17-07 minutes could not be approved due to lack of correct quorum.

 

 

ADJOURNMENT:

 

A motion to adjourn was made by Charles Packard, seconded by Carl Eligh.  All in favor; motion carried.
