ZONING BOARD OF APPEALS

June 20, 2007

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, June 20, 2007, at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Carl Eligh, John Gravino, Charles Packard and Ronald Santovito.  Also present were Code Enforcement Officer Michael Nelson and Board Clerk Susan Bush.  Absent was Councilman David McEwen.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARINGS:

 

Z-06-07 – Skyline North – 1604 Wayneport Road – Area Variance – Sections 135-190-A & C – Number & size of signs – Frank Leggio, President of Skyline North, was present to explain this request.  Skyline’s building is located on Wayneport Road adjacent to the new Wal-Mart and Lyons National Bank.  These projects have resulted in more vehicle traffic behind the Skyline building than in front of it along Wayneport Road.  Mr. Leggio would like to install a sign on the rear wall of his building to take advantage of the Wal-Mart traffic.  Variances are needed for a third sign and for exceeding the allowable square footage.  Colors and design would be in keeping with other Skyline signs.  No external illumination.  It was noted that another variance was previously granted for size of the front monument sign.

impact; returned to be handled as a local matter.

·        Town Board – No comment

·        SEQR – Not required at this level

 

There was no one else present to speak for or against the granting of this variance.

 

Z-07-07 – Hyde – 811 Turner Road – Area Variance – Section 135-61-B-3 – Accessory structure larger than allowed by Code – Richard Hyde was present to explain this request.  He would like to build a 30’ x 70’ pole barn, which would exceed the size of his residence by 200 sq. ft.  Barn would be used for the storage of personal items, tractors, trailer, etc.  It will be located behind the house with the narrow end facing the road.  These factors will make it difficult to see from the road.  No commercial use will be made of the structure; no animals will be housed.

Z-08-07 – Colf – 996 Turner Road – Area Variance – Section 135 Schedule I (Attachment 1) – Front setback – Amy Colf was present to explain this request.  She would like to add a front porch to her residence, which would require a 6 ft. variance from the 60 ft. setback.  She would like to have a place where she can sit to watch her children as they play in the front yard.  Porch will be a concrete slab with pillars and roof.  It was noted that a variance was previously granted on this property for a garage and master bedroom addition.

There was no one else present to speak for or against the granting of this variance.

 

BOARD DISCUSSION:

 

Z-06-07 – Skyline North – 1604 Wayneport Road – Area Variance – Sections 135-190-A & C – Number & size of signs – A motion was made by Carl Eligh, seconded by John Gravino, to grant these variances per plans, with the consideration that the back of this building is now in front of another business.  The five factors were reviewed.

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes;  Therefore, these variances are granted.

 

Z-07-07 – Hyde – 811 Turner Road – Area Variance – Section 135-61-B-3 – Accessory structure larger than allowed by Code – A motion was made by John Gravino, seconded by Carl Eligh, to grant this variance.  Members felt there would be minimum visual impact due to orientation of the building.  The five factors were reviewed.

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes; Therefore, this variance is granted.

 

Z-08-07 – Colf – 996 Turner Road – Area Variance – Section 135 Schedule I (Attachment 1) – Front setback – A motion was made by John Gravino, seconded by Ron Santovito, to grant this variance per the application for a 24 ft. x 6 ft. porch.  The five factors were reviewed.  Members felt this would not change the character of the neighborhood and would have been within the limits of the zoning code in effect when the residence was built.

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes; Therefore, this variance is granted.

 

MINUTES:

 

A motion to approve the 05-16-07 minutes was made by Carl Eligh, seconded by Charlie Packard.  All in favor; minutes approved.

A motion to adjourn was made by John Gravino, seconded by Charlie Packard.  All in favor; meeting adjourned at 8:07 p.m.
