ZONING BOARD OF APPEALS

May 16, 2007

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, May 17, 2007, at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Carl Eligh, John Gravino, Charles Packard and Ronald Santovito.  Also present were Councilman David McEwen and Board Clerk Susan Bush.  Absent was Code Enforcement Officer Michael Nelson.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-05-07 – Benedict – 927 Turner Road – Area Variance – Section 135 Schedule I (Attachment 1) – Side setback for addition – Applicant Larry Benedict was in attendance to explain this request.  They would like to expand their garage by 12 ft. to the side, resulting in a 10 ft. side setback.  The addition would not come any closer to the road and will mirror the present garage in appearance.  House was built in 1976 and conformed to codes at that time.  However, codes have changed, and this house is now considered pre-existing, non-conforming for setbacks.

·        Wayne County Planning Board – Referral not required

·        SEQR – Not required

 

There was no one else present to speak for or against the granting of this variance.

 

 

BOARD DISCUSSION:

 

Z-05-07 – Benedict – 927 Turner Road – Area Variance – Section 135 Schedule I (Attachment 1) – Side setback for addition – A motion was made by John Gravino, seconded by Carl Eligh, to grant a variance for side setback not to exceed 10 ft.  Board members felt this addition fit the character of the neighborhood, and other nearby residences have similar garages.  The five factors were reviewed. 

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes;  Therefore, this variance is granted.

A motion to approve the 03-21-07 minutes was made by Carl Eligh, seconded by John Gravino.  All in favor; minutes approved.

Motion to adjourn was made by John Gravino, seconded by Charles Packard.  All in favor; meeting adjourned at 8:43 p.m.
