ZONING BOARD OF APPEALS

January 17, 2007

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, January 17, 2007, at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Carl Eligh, John Gravino, Charles Packard and Ronald Santovito.  Absent were Town Engineer Scott Allen and Councilman David McEwen.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-09-06 – Boscan – 2393 Cornwall Drive – Area Variance – Section 135 Schedule I (Attachment 1) – Front setback for addition – Jon Cauwels was present on behalf of the applicant, Marie Boscan, who would like to add a new attached two-car garage (24 ft. x 28 ft.) and renovate the present garage into living space.  An existing swimming pool limits the location of the addition.  Home is considered pre-existing, non-conforming for front setback.  Code has been changed to 60 ft. vs. 50 ft. required at the time of original construction.  Mr. Cauwels stated there would be no commercial use of the new garage space.  There was no one else present to speak for or against the granting of this variance.

·        Wayne County Planning Board – Referral not required

·        SEQR – Not required

 

BOARD DISCUSSION:

 

Z-09-06 – Boscan2393 Cornwall Drive – Area Variance – Section 135 Schedule I (Attachment 1) – Front setback for addition – Motion was made by John Gravino, seconded by Charles Packard, to approve this area variance for a 42 ft. front setback (18 ft. variance).  The five factors were reviewed.

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes.  Therefore, this variance is granted.

 

MINUTES:

 

A motion to approve the 11-15-06 minutes was made by John Gravino, seconded by Carl Eligh.  All in favor; minutes approved.
