ZONING BOARD OF APPEALS

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, September 20, 2006, at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Carl Eligh, John Gravino and Charles Packard.  Also present was Councilman Dave McEwen and Board Clerk Susan Bush.  Absent were Ron Santovito and Town Engineer Scott Allen.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-07-06 – Rugaber – 1490 Willowdale Drive – Area Variance – Section 135 Schedule I (Attachment 1) – Side setback for residential addition – Nancy & Bruce Rugaber were present to explain this request.  They would like to remove an existing carport and expand their one-car garage to a two-car garage.   The addition would be slightly wider than the carport, resulting in a 12 ft. side setback.  Letters of support were received from the adjoining neighbors at 1484 and 1496 Willowdale Drive.  There was no one else present to speak for or against the granting of this variance.

·        Wayne County Planning Board – Referral not required

·        SEQR – Not required

 

BOARD DISCUSSION:

 

Z-07-06 – Rugaber – 1490 Willowdale Drive – Area Variance – Section 135 Schedule I (Attachment 1) – Side setback for residential addition – Motion made by John Gravino, seconded by Carl Eligh, to grant this variance per the application.  Members discussed the fact the house was built prior to current Code standards, and this addition would not be out of character for the neighborhood.  The five factors were reviewed.

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – absent; Jeffries – yes; Therefore, this variance is granted.

 

MINUTES:

 

A motion to approve the 08-16-06 minutes was made by Carl Eligh, seconded by John Gravino.  All in favor; minutes approved.
