ZONING BOARD OF APPEALS

August 16, 2006

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, August 16, 2006, at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and members Carl Eligh, John Gravino, Charles Packard and Ron Santovito.  Also present were Town Councilman Dave McEwen and Board Clerk Susan Bush.  Absent was Town Engineer Scott Allen.

 

Mr. Jeffries called the meeting to order at 7:32 p.m.  He then explained the purpose for which this board serves and read the Legal Notice as it appeared in the Times.

 

PUBLIC HEARING:

 

Z-06-06 – Brogan/Feor Construction – 3031 Kittering Road – Area Variance – Section 135 Schedule I (Attachment 1) – Side setback for residential addition – Kevin Feor, Feor Construction, and Robert Brogan were present to explain this request.  Property owner would like to expand the existing one-car garage to a two-car garage.  This 14 ft. expansion would result in a side setback of 20 ft. vs. 25 ft. required by Code.  Due to the house design, the proposed plan is the only feasible way to provide additional garage space.  Adjoining property on the garage side (south) is open farmland.  There was no one else present to speak for or against the granting of this variance.

 

              Planning Board – Positive referral

              Town Board – No concerns

              Wayne County Planning Board – Referral not required

              SEQR – Not required

 

BOARD DISCUSSION:

 

Z-06-06 – Brogan/Feor Construction – 303l Kittering Road – Area Variance – Section 135 Schedule I (Attachment 1) – Side setback for residential addition – Motion made by John Gravino, seconded by Carl Eligh, to grant this variance for side setback per application.  The five factors were reviewed.

 

Roll Vote:  Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes; Therefore, this variance is granted.

 

MINUTES:

 

Motion made by Charles Packard, seconded by John Gravino, to approve the 07-19-06 minutes with the following amendment:  Z-05-06 – Valentine – 2028 Daansen Road – Public Hearing – Septic system for adjoining property (2038 Daansen Road) is located in the open area between the two residences, and due to that fact, the “double” lot would not be subdivided.  All in favor; minutes approved.
