ZONING BOARD OF APPEALS

July 14, 2004

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, July 14, 2004, at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries and members Carl Eligh, John Gravino, Charles Packard and Ron Santovito. Also present was Town Engineer Scott Allen. Absent was Councilman David Maul.

Mr. Jeffries called the meeting to order at 7:31 p.m. He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

PUBLIC HEARINGS:

Z-08-04 – Johnson – 135 Burnham Heights – Area Variance – Section 135-61-A – Garage larger than allowed by Code and Section 135-162-B – Expansion of a non-conforming building – Anson Johnson, Jr. was present to explain his application. He would like to increase the size of his garage to allow for a workshop and add a 3-season room to the back of his home. Workshop would be for personal use only. Residence is currently a non-conforming building due to existing 12 ft. side setback. A letter of support was received from Beverly Williams, 127 Burnham Heights, whose property adjoins his on that side. There was no one else present to speak for or against the granting of these variances.

Planning Board – No concerns

Town Board – No input

Wayne County Planning Board – No intermunicipal or countywide impact

SEQR – Not required

The public hearing was then closed.

Z-09-04 – Boesel – 911 Bunker Hill Drive – Area Variance – Section 135-61-

A – Garage larger than allowed by Code and Section 135-61-B-5 (Schedule I) – Side setback – Donald Boesel was present to explain his application. He would like to build a detached garage to accommodate a workshop, storage for personal items and an occasional vehicle. Existing shed on the property would remain. Present garage (under house) is used for storage of personal items not vehicles. Requested 9 ft. setback would be comparable to that of adjacent property owner's garage. Structure will be one story and sided to match the house. A letter of support was received from Rick & Christine Worth, 919 Bunker Hill Drive. There was no one else present to speak for or against the granting of these variances.

BOARD DISCUSSIONS:

Z-08-04 – Johnson – 135 Burnham Heights – Area Variance – Section 135-61-A-Garage larger than allowed by Code & Section 135-162-B – Expansion of a non-conforming building – Motion made by John Gravino, seconded by Charles Packard, to grant these variances as requested with an 18-month abandonment clause. It was noted this residence is a pre-existing non-conforming building. The five factors were reviewed.

Roll Vote: Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes. Therefore, these variances are granted.

Z-09-04 – Boesel – 911 Bunker Hill Drive – Area Variance – Section 135-61-A – Garage larger than allowed by Code & Section 135-61-B-5 (Schedule I) – Side setback – Motion made by Carl Eligh, seconded by Ron Santovito, to grant these variances as requested with an 18-month abandonment clause. This lot presents unusual circumstances due to topography. Also, adjoining property owner's garage has a similar setback as that requested. The five factors were reviewed.

Roll Vote: Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes. Therefore, these variances are granted.
