ZONING BOARD OF APPEALS

March 10, 2004

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, March 10, 2004, at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries, members Carl Eligh, Charles Packard and Ron Santovito. Absent were member John Gravino, Councilman David Maul and Town Engineer Scott Allen.

Mr. Jeffries called the meeting to order at 7:30 p.m. and explained the purpose for which this Board serves. He then read the Legal Notice as it appeared in the "Times".

 

PUBLIC HEARINGS:

Z-03-04 – Sampson/2340 Morrison Drive/Area Variance – Sections 135 Schedule I & 135-61-A – Side setback and garage space more than allowed by Code – John Sampson and Laura Moss were present to explain this application. Mr. Sampson would like adequate garage space to store classic cars and personal possessions. This addition would result in an encroachment on the side setback of 2.5 to 5 ft. Second floor above the garage would be used for living space. A letter of support from the adjoining neighbors, Stanley & Lona Breitkopf, 2344 Morrison Drive, was included with the application. No commercial use will be made of this space. There was no one else present to speak for or against the granting of these variances.

Town Board – Memo from Councilman Maul indicating the Town has no

objections

Planning Board – Positive referral

Wayne County Planning Board – Not required

SEQR – Not required

The public hearing was then closed.

Z-02-04 – Wayside Garden Center/124 Pittsford-Palmyra Road (Route 31)/Area Variance – Section 135-162-B – Expansion of a non-conforming building – No one was present to speak for or against the granting of this variance. Ron Santovito questioned the number of parking spaces required for this retail operation and the number of spaces lost due to the building expansion.

Town Board – No objections; suggested appropriate vehicle traffic control

through signs and/or striping in narrower traffic areas

Wayne County Planning Board – No intermunicipal impact

Planning Board – Positive referral

SEQR – Not required

The public hearing was then closed.

 

BOARD DISCUSSION:

Z-03-04 – Sampson/2340 Morrison Drive/Area Variance – Sections 135 Schedule I & 135-61-A – Side setback and garage space more than allowed by Code

Motion made by Carl Eligh, seconded by Ron Santovito, to grant these variances for 25 ft. x 40 ft. garage with 20 ft. side setback and 18-month abandonment clause. The five factors were then reviewed.

Roll Vote: Eligh – yes; Packard – yes; Santovito – yes; Jeffries – yes; Therefore, these variances are granted.

Z-02-04 – Wayside Garden Center/124 Pittsford-Palmyra Road (Route 31)/Area Variance – Section 135-162-B – Expansion of a non-conforming building

Motion made by Charles Packard, seconded by Carl Eligh, to deny the granting of this variance due to lack of representation by the applicant.

Roll Vote: Eligh – yes; Packard – yes; Santovito – yes; Jeffries – yes; Therefore, this variance is denied.

 

MINUTES:

Motion made by Warren Jeffries, seconded by Charles Packard, to approve the 2/11/04 minutes with a correction removing the word "maximum" from the amended motion to approve variance for Giles (Z-01-04). All in favor; minutes approved.
