ZONING BOARD OF APPEALS

February 11, 2004

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, February 11, 2004, at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries, members Carl Eligh, John Gravino and Charles Packard. Absent were member Ron Santovito, Councilman David Maul and Town Engineer Scott Allen.

Mr. Jeffries called the meeting to order at 7:30 p.m. and explained the purpose for which this Board serves. He then read the Legal Notice as it appeared in the "Times".

 

PUBLIC HEARING:

Z-01-04 – Giles/2033 Quaker Road/Area Variance – Section 135 Schedule I – Side setback for garage – Roger Giles and Kathleen Moulton were present to explain this application. Mr. Giles would like to build a detached two-car garage with a 2-foot setback from the side property line. This structure would be used for storage of vehicles, lawn equipment and personal items. Location of septic system behind house & topography of lot (hillside) make placement of this structure difficult. Neighbor's house is approximately 125 ft. away from this property line. Size of the garage was discussed, and Mr. Giles stated he would like to install two 9-ft. garage doors to accommodate a full-size pickup. John Gravino asked about the neighbor's response to this project, and Mr. Giles stated he and the neighbor had not discussed it. Existing retaining wall and stairs into the house were discussed. There was no one else present to speak for or against the granting of this variance.

Town Board – Neighbors' input is important. Two feet is a very short distance.

Planning Board – Agreement with need for garage, but would like increase in

side setback

SEQR – Not required

Wayne County Planning Board – Not required

The public hearing was then closed.

 

BOARD DISCUSSION:

Z-01-04 – Giles/2033 Quaker Road/Area Variance – Section 135 Schedule I – Side setback for garage

Motion made by Carl Eligh, seconded by Charles Packard, to grant this variance for a 24' x 24' accessory structure with an 18-month abandonment clause. John Gravino felt the requested setback was too close to the property line and applicant has other options. Mr. Packard & Mr. Eligh concurred with these concerns. Warren Jeffries reviewed the extenuating circumstances of the hill, the distance to the neighbor's house and visibility of the structure from the neighbor's house. Consensus was a 10-ft. setback would be acceptable, allowing for roof overhang & maintenance on outside without infringing on the neighbor's property. Amended motion made by Carl Eligh, seconded by Charles Packard, to grant this variance for a maximum 10-ft. side setback with 18-month abandonment clause. The five factors were reviewed.

Roll Vote: Eligh – yes; Gravino – yes; Packard – yes; Jeffries – yes; Therefore, this variance is granted.

 

MINUTES:

Motion made by John Gravino, seconded by Charles Packard, to approve the 1/14/04 minutes with amendments (correction of date from January 15 to January 14 & adding "personal" to describe property under Vienna application/public hearing). All in favor; minutes approved.

 

OTHER BUSINESS:

Mr. Jeffries explained packet of information given to Board members regarding recent legal action.

Motion to adjourn the meeting made by John Gravino, seconded by Charles Packard. Meeting adjourned at 8:04 p.m.
