ZONING BOARD OF APPEALS

THE TOWN OF MACEDON ZONING BOARD OF APPEALS MEETING WAS HELD ON WEDNESDAY, AUGUST 13, 2003, AT THE TOWN COMPLEX, 32 MAIN STREET, MACEDON, NY. PRESENT WERE CHAIRMAN WARREN JEFFRIES, MEMBERS JOHN GRAVINO AND CHARLES PACKARD. ABSENT WERE MEMBER CARL ELIGH, TOWN COUNCILMAN DAVID MAUL AND TOWN ENGINEER SCOTT ALLEN.

Mr. Jeffries called the meeting to order at 7:31 p.m. He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the "Times".

 

PUBLIC HEARINGS:

Z-12-03 – Alfieri/190 Furman Rd/Area Variance – Section 135 Schedule I – Garage/principal structure within front & side setbacks

Jerry & Jeanette Alfieri were present to explain their request. They are converting a portion of their garage to living quarters & expanding the garage on the front. Variance sought is 5 ft. on the front setback (55 ft. vs. 60 ft. required) and 4 ft. on the side (21 ft. vs. 25 ft. required). Expansion into the rear yard would not be feasible due to a finished patio and swimming pool. Mr. Alfieri stated he has spoken with the neighbors on each side, and they have no objections. Additionally, one adjacent residence is an older farmhouse with a shorter front setback than that proposed by the Alfieri's. There was no one else present to speak for or against the granting of this variance.

Z-13-03 – Wootton/1648 Canandaigua Rd/Area Variance – Section 135-61-B-5 – Accessory structure in side/front yard

Kathryn Wootton explained the unusual circumstances with their property. Their rear lawn is within the 100 ft. buffer zone of a designated wetland. They have contacted DEC, who advised approval for a shed in the rear yard would be a difficult task. Therefore, they have asked for a variance to construct this shed in the front/side yard. Placement on the other side of the house would make access to lawn & snow removal equipment difficult. There is another metal shed on the property, which the owners intend to keep as well. Letters of support were presented from the following neighbors:

Mary & Kenneth Henning, 1690 Canandaigua Road; William Henning, 1712 Canandaigua Road; Marcia & Jim Henning, 1720 Canandaigua Road; Jane Henning, 1726 Canandaigua Road; Mark Henning, 1171 State Route 31. There was no one else present to speak for or against the granting of this variance.

Z-14-03 – Schroeder/826 Alderman Road/Area Variance – Section 135-61-B-5 – Accessory structure in side yard

Beth Schroeder was present to explain her application. This lot is approximately 4 acres with 2 acres cleared. Due to the unusual shape of the lot, desired placement of the shed puts it in the side yard. It is approximately 60 ft. from the neighboring lot line and 120 ft. from the house. The property's topography also lends itself to this placement. Ms. Schroeder is willing to landscape around the shed to make it more aesthetically pleasing. She was also able to speak with one neighbor, who has no objection. No commercial use will be made of this structure. There was no one else present to speak for or against the granting of this variance.

Z-15-03 – Colf/996 Turner Road/Area Variance – Section 135 Schedule I – Expansion of structure within side setback

Amy Colf was present to explain this request. They currently have a one-car garage & wish to expand to two, with a master bedroom being added over the garage. This addition would require a 3 ft. variance from the side setback (22 ft. vs. 25 ft.). There was no one else present to speak for or against the granting of this variance.

- SEQR – Not required

BOARD DISCUSSION:

Motion made by John Gravino, seconded by Charles Packard, to grant this request with a 5 ft. variance on the front setback (55 ft. vs. 60 ft. required) and a 4 ft. variance on the side setback (21 ft. vs. 25 ft. required) with an 18-month abandonment clause. The five factors were then reviewed.

Roll Vote: Gravino – yes; Packard – yes; Jeffries – yes; Therefore, these variances are granted.

Z-13-03 – Wootton/1648 Canandaigua Road/Area Variance – Section 135-61-B-5 – Accessory structure in side/front yard

Motion made by John Gravino, seconded by Charles Packard, to grant this variance. Due to the involvement of DEC wetlands, the Board felt this was a reasonable request. The five factors were then reviewed.

Roll Vote: Gravino – yes; Packard – yes; Jeffries – yes; Therefore, this variance is granted.

Z-14-03 – Schroeder/826 Alderman Road/Area Variance – Section 135-61-B-5 – Accessory structure in side yard

Motion made by John Gravino, seconded by Charles Packard, to grant this variance. Board would like to see shrubbery installed around shed. The five factors were then reviewed.

Roll Vote: Gravino – yes; Packard – yes; Jeffries – yes; Therefore, this variance is granted.

Z-15-03 – Colf/996 Turner Road/Area Variance – Section 135 Schedule I – Expansion of structure within side setback

Motion made by John Gravino, seconded by Charles Packard, to grant this 3 ft. variance

of the side setback (22 ft. vs. 25 ft. required) with an 18-month abandonment clause. The five factors were then reviewed.

Roll Vote: Gravino – yes; Packard – yes; Jeffries – yes; Therefore, this variance is granted.

 

 

OTHER BUSINESS:

Candidate Interviews: Mr. Jeffries gave an overview of the ZBA and answered questions from the candidates. Individual interviews were then conducted for:

Motion made by Charles Packard, seconded by John Gravino, to enter executive session to review personnel matters. All in favor; Board entered executive session at 9:19 p.m.
