ZONING BOARD OF APPEALS

THE TOWN OF MACEDON ZONING BOARD OF APPEALS MEETING WAS HELD ON WEDNESDAY, JULY 9, 2003, AT THE TOWN COMPLEX, 32 MAIN STREET, MACEDON, NY. PRESENT WERE CHAIRMAN WARREN JEFFRIES, MEMBERS CARL ELIGH, JOHN GRAVINO AND CHARLES PACKARD. ALSO PRESENT WERE TOWN COUNCILMAN DAVID MAUL AND TOWN ENGINEER SCOTT ALLEN. ABSENT WAS MEMBER HELEN SAVERSKY.

Mr. Jeffries called the meeting to order at 7:30 p.m. He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the "Times".

 

PUBLIC HEARINGS:

Z-09-03 – Arnold/1840 Crest Avenue/Area Variance – Section 135-61-B-5 – Detached structure in side yard

Applicant Douglas Arnold was present to explain his request. He would like to place a 10' x 12' shed in his side yard next to his garage. His rear yard is wet, and placing the shed there would block the drainage swale. A side placement would allow easier access for lawn and snow removal equipment storage. A 4' space would be maintained between the shed and garage. The property is on a dead-end street with no neighbor on that side.

There was no one else present to speak for or against the granting of this variance. The public hearing was then closed.

Z-10-03 – Macera & Kordzikowski/2593 Daansen Road/Area Variance – Sections 135-61-A, 135-61-B-3, 4, 5 – Garage space exceeding 800 sq. ft., accessory structure exceeds size/height of residence, accessory structure exceeds 16 ft. height, accessory structure located in front of residence

Applicants Ronald Macera and Doreen Kordzikowski were present to explain their request. They would like to build a pole barn between their home and the road. This would be used for the storage of vehicles, tractor, lawn mower and possibly a workshop. Their house is set back approximately 270 feet and cannot be seen from the road due to heavy woods. The pole barn would also not be visible from the road. At the present time the proposed site is the only usable area on the property without taking down trees. A large portion of the rear of the property is muck and too wet in the spring. Mr. Macera stated this building would not be used for any commercial endeavors. The second floor will be used for storage and a possible workshop. A letter was presented supporting this project signed by the following neighbors: Ken Hawkins, 2611 Daansen Road; Lori Bliss-Martin, 2498 Daansen Road; Peter Caton, 2554 Daansen Road; Nelson Whitcomb, 2635 Daansen Road; Kari Landry, 2579 Daansen Road; Cheryl Keirsbilck, 2569 Daansen Road; Andrew Stanton, 2548 Daansen Road.

Town Board – Mr. Maul indicated the Town Board had no concerns over

the nature of the request but would like to be specific on

height & size allowed if the variances are granted.

Planning Board – No concerns

SEQR - Not required

County Planning Board – Not required

No one else was present to speak for or against the granting of these variances. The public hearing was then closed.

Z-11-03 – Preston/1416 Canandaigua Road/Area Variance – Section 135 Schedule I

Accessory structure within 15 ft. side setback

Applicant Mark Preston was present to explain his request. He is replacing a shed that was damaged in the April ice storm. Previous shed was in same approximate area. He would like to build an addition on his house in the future, and this shed placement will allow him access to the rear yard for construction purposes. A letter from Bernard Kulesa, 1408 Canandaigua Road, in support of this project was presented.

SEQR – Not required

No one else was present to speak for or against the granting of this variance. The public hearing was then closed.

 

OLD BUSINESS:

Z-05-02 – Deys/1472 Macedon Center Road (Rt. 31F) – Request for extension on Area Variance

Richard Deys was present to request an extension on the Area Variance granted for his property at 1472 Macedon Center Road for a barn larger than allowed by Code (larger than square footage of residence). He stated he still intends to build this structure, but has had financial difficulties in the past year causing the project to be postponed. He now intends to have the structure completed by the spring of 2004.

A motion was made by John Gravino, seconded by Charles Packard, to grant a second 18-month abandonment period for this variance to expire on March 13, 2005 under Section 135-61-B-3.

Roll call vote was taken as follows: Eligh – yes; Gravino – yes; Packard – yes; Jeffries – yes. Therefore, this request for extension is granted.

 

BOARD DISCUSSIONS:

Motion made by Carl Eligh, seconded by John Gravino, to grant this variance for a 10' x 12' shed to be placed in the side yard not less than nine (9) feet back from the front line of the garage with an 18-month abandonment clause. The five factors were then reviewed.

Roll vote: Eligh – yes; Gravino – yes; Packard – yes; Jeffries – yes; Therefore, this variance is granted.

Z-10-03 – Macera & Kordzikowski/2593 Daansen Road/Area Variance – Sections 135-61-A, 135-61-B-3, 4, 5 – Garage space exceeding 800 sq. ft., accessory structure exceeds size/height of residence, accessory structure exceeds 16 ft. height, accessory structure located in front of residence

Motion made by John Gravino, seconded by Carl Eligh, to grant these variances for one (1) accessory building with a maximum footprint of 24 feet x 26 feet, height not to exceed 22 feet, to be placed in the front yard not less than 140 feet from the road with an 18-month abandonment clause.

This type of variance has been granted before. The house is set back a long distance from the road & the barn will not be visible from the road. The five factors were then reviewed.

Roll vote: Eligh – yes; Gravino – yes; Packard – yes; Jeffries – yes; Therefore, these variances are granted.

Z-11-03 – Preston/1416 Canandaigua Road/Area Variance – Section 135 Schedule I

Accessory structure within 15 ft. side setback

Motion made by John Gravino, seconded by Charles Packard, to grant this variance for a 10' x 14' shed to be placed not less than four (4) feet from the side property line with a 12-month abandonment clause.

Extenuating circumstances were discussed – previous shed in same location & access to the rear of the property. Five factors were then reviewed.

Roll vote: Eligh – yes; Gravino – yes; Packard – yes; Jeffries – yes; Therefore, this variance is granted.

Motion made by John Gravino, seconded by Carl Eligh, to approve the 5-14-03 minutes. All in favor; minutes approved.

Motion made by Carl Eligh, seconded by Charles Packard, to approve the 6-11-03 minutes. All in favor; minutes approved.

 

OTHER BUSINESS:

Mr. Jeffries informed the Board of Helen Saversky's resignation, effective June 23, 2003. Mr. Maul indicated the Town Board would begin the replacement process at its July 10th meeting.
