ZONING BOARD OF APPEALS - MINUTES

November 13, 2002

 

THE TOWN OF MACEDON ZONING BOARD OF APPEALS MEETING WAS HELD ON WEDNESDAY, NOVEMBER 13, 2002, AT THE TOWN COMPLEX, 1675 NORTH WAYNEPORT ROAD, MACEDON, NY.  PRESENT WERE:  CHAIRMAN WARREN JEFFRIES, MEMBERS CARL ELIGH, CHARLES PACKARD AND HELEN SAVERSKY.  ALSO PRESENT WERE TOWN ENGINEER SCOTT ALLEN AND COUNCILMAN DAVID MAUL.  ABSENT WAS MEMBER JOHN GRAVINO.

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the "Times".

 

PUBLIC HEARING:

 

Z-24-02 - Brian Haney/722 South Wayenport Road/Area Variance Section 135-61-A

Request to expand garage to size larger than allowed by code

 

Brian Haney was present to address the Board regarding his application.  He would like to expand his garage for additional storage.  Present garage is 24' x 28' - 672 sq. ft. Mr. Haney is a self-employed mason; however, he stated this space would not be used for commercial purposes nor the housing of farm animals.  Expansion would also be within the proper side setback distance.  Mr. Haney presented a letter from his neighbor on that side, Mark Leonardo, 712 Wayneport Road, in support of this proposed addition.  There was no one else present to speak for or against this variance.

 

-          Town Board has no concerns

-          Planning Board has no concerns

-          Wayne County Planning Board - no intermunicipal or countrywide impact

 

Public hearing was then closed.

 

BOARD DISCUSSION:

 

Z-24-02 - Brian Haney/722 South Wayneport Road/Area Variance Section 135-61-A

Request to expand garage to size larger than allowed by code

 

Motion made by Helen Saversky, seconded by Carl Eligh, to approve this variance with a 12-month abandonment clause.  Five factors were then reviewed.

 

Roll Vote:  Eligh - yes; Packard - yes; Saversky - yes; Jeffries - yes; Therefore, this variance is granted.

 

MINUTES:  Motion made by Helen Saversky, seconded by Carl Eligh, to approve the October 9th minutes.  All in favor; minutes approved.

 

OTHER BUSINESS: 

 

Z-20-02 - Marc & Nancy Weiner/1113 Erie St. Rd./Area Variance Section 135-61-B(4)

Dave Maul advised the Board what action had been discussed at the Town Board level regarding the condition placed upon this variance (removal of window) and the recommended fine.  He

 

 

stated the Town Board had suggested to Mr. Weiner that he and his neighbors (the Sitters) come to an agreement regarding the window in question and present that agreement to the ZBA for possible amendment to the variance decision.  The matter of the fine had been tabled at the Town Board level.  A request was then made to the Board Clerk to follow up with Mr. Weiner to determine what had been done.

Motion made by Charles Packard, seconded by Helen Saversky, to adjourn the meeting.  Meeting adjourned at 8:02 p.m.
