APPEALS BOARD MINUTES

August 14, 2002

 

 

THE TOWN OF MACEDON ZONING BOARD OF APPEALS MEETING WAS HELD ON WEDNESDAY, AUGUST 14, 2002, AT THE TOWN COMPLEX, 1675 N. WAYNEPORT ROAD, MACEDON, NY.  PRESENT WERE:  CHAIRMAN WARREN JEFFRIES, MEMBERS JOHN GRAVINO AND CHARLES PACKARD.  ALSO PRESENT WERE TOWN ENGINEER, SCOTT ALLEN, AND COUNCILMAN DAVID MAUL.            

 

Mr. Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which this Board serves and read the legal notice as it appeared in the "Times".

 

PUBLIC HEARING:

 

Sanson/NE Corner of Wilkinson & Wilson Roads/Area Variance Sections 135-61-B(3), 135-61-B(4) & 135-61-D(3)/ Request to build accessory structure housing horses larger than allowed by code

 

David Matthews of Matthews Consulting was there to represent Mr. and Mrs. Sanson, who were also present in the audience.  The Sansons would like to construct a horse barn on this 16+ acre parcel.  Horses would be for personal recreation only, and fewer than 5 animals would be housed in this barn.  Building would also encompass an indoor riding arena, which would allow the owners the use of their horses during inclement weather.  Mr. Matthews explained that variances are required because the barn will be larger in square footage than allowed by code (greater than house & overall size - approx. 13,500 vs. 1,500 sq. ft.) and higher than allowed by code (approx. 28' vs. 16').  He also pointed out there are similar barns within the Town.  Driveway onto property will be placed to avoid any impact on the wetlands area along Wilson Road.  John Gravino questioned the disposal of manure, and response was there would be room on the property.   The Sansons have a purchase offer on this parcel, subject to approval of the required variances, and have received sketch plan approval from the Planning Board.  No one else was present to speak for or against this application.

 

-          Planning Board gave a favorable recommendation.

-          Town Board has no objection

-          No SEQR required

-          County referral not required

 

Public hearing was closed at 7:42 p.m.

 

BOARD DISCUSSION:

 

Sanson/NE Corner Wilkinson & Wilson Roads/Area Variance Sections 135-61-B(3), 135-61-B(4) & 135-61-D(3)/Request to build accessory structure housing horses larger than allowed by code

 

Motion to approve this applicataion contingent upon transfer of property to applicants with an 18-month abandonment clause made by John Gravino, seconded by Charles Packard.  John Gravino felt this was a good use of this property.  It was noted that barn will probably not be visible from the roads due to vegetation.   Mr. Jeffries added that this is a large lot - 16+ acres.  Five factors concerning an area variance were reviewed. 

 

Roll Vote:  Gravino - yes; Packard - yes; Jeffries - yes;  Therefore, this variance is granted.

 

MINUTES:

 

Minutes of the June 12, 2002 meeting were reviewed.  Motion made by Charles Packard, seconded by John Gravino, to approve these minutes.  Motion carried unanimously. 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

OTHER BUSINESS:

 

Three candidates for the open Board seat were present for interviews.  Chairman Jeffries explained what the position encompassed, time involved, where and when meetings are held and the need to attend a one-day training course.  He also explained that each seat on the Board is for a 5-year term; however, the current opening is to fill a term expiring at the end of 2002.  Applicants were:  Carl Eligh, 3245 Hance Road; Kevin Evans, 1258 Marvin Drive; Robert Meyers, 394 Canal Drive East.  Individual interviews were conducted & Councilman Maul will take the recommendation to the Town Board at its next meeting (August 22nd).

 

Motion to adjourn made by Charles Packard, seconded by John Gravino.  Meeting adjourned at 8:46 p.m.
