APPEALS BOARD MINUTES
 May 8, 2001

THE TOWN OF MACEDON ZONING BOARD OF APPEALS MEETING WAS HELD ON TUESDAY, MAY 8, 2001 AT THE MACEDON ELEMENTARY SCHOOL, MACEDON, NEW YORK.  PRESENT WERE, CHAIRMAN WARREN JEFFRIES, MEMBERS, SUE BUSH, CHARLES PACKARD AND JOHN GRAVINO.  ALSO PRESENT WAS BUILDING AND ZONING OFFICER, MARIO FIORAVANTI.  ABSENT WERE ZBA MEMBER HELEN SAVERSKY AND TOWN BOARD MEMBER DAVID MAUL.

Mr. Jeffries called the meeting to order at 7:30 p.m.  Mr. Jeffries explained the purpose for which this board serves and read the legal notice as it appeared in the “Times”.

PUBLIC HEARING:

Deborah Ayers / 708 Alderman Rd / Area Variance - Section 135-62 schedule 1 / Would like to build a front porch with a roof closer to lot lines than allowed by town code
Deborah Ayers was present to address the board concerning this application.  Deborah stated that currently there is a 4'x4' stoop at the front door of her residence and it needs replacement.  She stated that she would like to replace it with an 8'x14' front porch with a roof.  She stated the roof would also be the 8' width and would peak into the existing house roof.  Deborah stated that her house currently only sits 50' from the road.  No one else was present to speak for or against the granting of this variance.
 -Planning Board had no comment on this application
-Town Board had no objections
-Wayne County Planning Board had no comment on this application

Daniel and Linda Conant / 2103 Barnes Rd / Area Variance - Section 135-61-d-2 and 135-61-d-3 / Would like to build a60'x156' pole barn
Daniel and Linda Conant were present to address the board.  Linda stated that they would like to build a barn to house their five horses and an inside-riding arena.  She stated that the horses are currently boarded off the property.  Linda continued to explain that due to some of the horses being show horses it was important for them to have an inside riding arena to exercise them.  Linda explained that that they currently own 7.85 acres and have an approved purchase offer for approximately 3 additional acres.  There is currently no accessory structure and the road shown on the map is proposed.  The barn will have 9 stalls and will house the five horses.  It was asked when the applicants were going to close on the additional property purchase.  It was determined that the applicant needs to submit to the planning board for a realty subdivision prior to closing but the barn would not be built until after the closing has occurred.  Bruce Niven of Hance Rd was present to speak in favor of the granting of this variance.  He stated that several neighbors on the road have horses with larger barns and the addition of this barn will not hinder the appearance of the neighborhood.  No one else was present to speak for or against the granting of this application.
 -Planning Board had no concerns with this application.
 -Town Board stated that they had no concerns with this request providing the additional land is indeed acquired.
 -Wayne County Planning Board recommended conditional approval

BOARD DISCUSSION

Deborah Ayers / 708 Alderman Rd / Area Variance - Section 135-62 schedule 1 / Would like to build a front porch closer to lot lines than allowed by town code
A motion was made by Sue Bush to grant this variance under Section 135-62 schedule 1 for 708 Alderman Rd with an 18-month abandonment clause, seconded by John Gravino.  Five factors concerning an area variance were reviewed.
Roll Vote: Gravino-yes  Bush-yes  Packard-yes  Jeffries-yes Therefor this variance is granted.

Daniel and Linda Conant / 2103 Barnes Rd / Area Variance - Section 135-61-d-2 and 135-61-d-3 / Would like to build a 60'x156' pole barn
A motion was made by John Gravino to grant this variance under section 135-61-d-2 for 2103 Barnes Rd with an 18-month abandonment clause and pending the purchase of the additional land, seconded by Charles Packard  Five factors concerning an area variance were reviewed.
Roll Vote:  Gravino-yes  Bush-yes  Packard-yes  Jeffries-yes  Therefor this variance is granted.
