The Regular Meeting of the Town Board of the Town of Macedon held August 10, 2017 at the Town Complex, 32 Main Street, in the Town of Macedon was called to order by Supervisor Sandy Pagano at 7:30 p.m.

RESOLVED the Board authorizes the Highway Superintendent to increase the CHIPS (Consolidated Local Street and Highway Improvement Program) account DA5112.200 from $130,366 to $196,772.12 for 2017 due to the dissolution of the Village of Macedon.

RESOLUTION NO. 216 (2017) LARSEN ENGINEERS / ABUNDANT SOLAR

WHEREAS, Larsen Engineers / Abundant Solar has applied to the Town of Macedon for approvals to construct a 2 MW ground mounted solar array at 644 NYS Route 31;

 

AND WHEREAS, the Applicant requires issuance of a Special Use Permit by the Macedon Town Board, as well as Site Plan approval from the Macedon Planning Board;

 

AND WHEREAS, the highest approval authority on the project lies with the Macedon Town Board;

 

AND WHEREAS, the application is an Unlisted Action pursuant to SEQRA;

 

RESOLVED, The Macedon Town Board declares its intent to act as Lead Agent for the SEQRA review process, and

 

BE IT FURTHER RESOLVED, the Macedon Town Board refers the application for a Special Use Permit to the Town and County Planning Boards for review and recommendation, and

 

BE IT FURTHER RESOLVED, the Town Board schedules a public hearing on September 14, 2017 at 7:45 pm to hear public comment on the proposed Special Use Permit application.

RESOLUTION NO. 218 (2017) RESOLUTION SEEKING COUNTY AND SCHOOL PARTICIPATION IN ARTICLE 7 LITIGATION EXPENSES FOR THE YEAR 2017-2018 – DB PROPERTIES, LLC.

WHEREAS, DB Properties, LLC. Has commenced a proceeding pursuant to Article 7 of the Real Property Tax Law for the year 2017-2018 in Wayne County Supreme Court under index number 81097, and

 

WHEREAS, because the litigation costs of these challenges can be more than the Town can anticipate and afford, and the effects of such litigation extend additionally to the school, village and country tax base, the County of Wayne has adopted a policy of municipal participation in the costs and expense of such litigation by resolution 307-10 date October 20, 2015 and

 

WHEREAS, the Town of Macedon attorney has advised the Town Board that this litigation meets the requirements of municipal participation in that the real property in question has an assessed value in excess of $1,000,000 and the petitioner is desirous of either a change of assessment of ten (10) percent or a change of at least $50,000 less than the assessed value, to wit:  assessment of $1,592,000 is sought to be reduced to $557,000 and

 

WHEREAS, the Town of Macedon attorney has advised the Town Board that this litigation meets the requirements of municipal participation in that the real property in question has an assessed value in excess of $1,000,000 and the petitioner is desirous of either a change of assessment of ten (10) percent or a change of at least $50,000 less than the assessed value, to wit:  assessment of $197,500 is sought to be reduced to $100,000 and

 

WHEREAS, the Town of Macedon, desires to qualify this litigation for Wayne County and Palmyra-Macedon School District participation to equally share the legal and appraisal costs of this litigation,

 

NOW, THEREFOR, BE IT RESOLVED that the Town of Macedon does hereby agree to share equally in the legal and appraisal costs of this litigation and does hereby request Wayne County and Palmyra-Macedon School District participation to share equally in the legal and appraisal costs of this litigation; and

 

BE IT FURTHER RESOLVED that the proceedings will involve the County Attorney and Real Property Tax Services Director as consultants regarding appraisals and/or settlement strategies and the Town Attorney is authorized to communicate pursuant to common defense confidentiality agreements with the County of Wayne and Palmyra-Macedon School District; and

 

BE IT FURTHER RESOLVED that the Town of Macedon hereby requests approval for County of Wayne, and Palmyra-Macedon School District participation in this litigation commenced under the index number set forth above for the year 2017-2018, and

 

BE IT FURTHER RESOLVED, that the Town of Macedon will pay its equal share of the legal and appraisal costs of this litigation, and

WHEREAS, because the litigation costs of these challenges can be more than the Town can anticipate and afford, and the effects of such litigation extend additionally to the school, village and country tax base, the County of Wayne has adopted a policy of municipal participation in the costs and expense of such litigation by resolution 307-10 date October 20, 2015 and

 

WHEREAS, the Town of Macedon attorney has advised the Town Board that this litigation meets the requirements of municipal participation in that the real property in question has an assessed value in excess of $1,000,000 and the petitioner is desirous of either a change of assessment of ten (10) percent or a change of at least $50,000 less than the assessed value, to wit:  assessment of $2,876,900 is sought to be reduced to $2,000,000 and

WHEREAS, because the litigation costs of these challenges can be more than the Town can anticipate and afford, and the effects of such litigation extend additionally to the school, village and country tax base, the County of Wayne has adopted a policy of municipal participation in the costs and expense of such litigation by resolution 307-10 date October 20, 2015 and

 

WHEREAS, the Town of Macedon attorney has advised the Town Board that this litigation meets the requirements of municipal participation in that the real property in question has an assessed value in excess of $1,000,000 and the petitioner is desirous of either a change of assessment of ten (10) percent or a change of at least $50,000 less than the assessed value, to wit:  assessment of $1,064,500 is sought to be reduced to $881,880.74 and

The work is the Macedon Water Storage Tank Demolition Project and consists of the demolition and removal of a 500,000-gallon water storage tank in accordance with the Bidding Documents heretofore prepared by GHD Consulting Services Inc. The Town of Macedon reserves the right to waive any informalities or to reject any or all Bids.

 

Bidders are required to certify, under penalty of perjury, that Bids have been prepared without collusion with other Bidders, subcontractors, suppliers, etc. This certification is included with the Bid Form and each Bidder must sign in the space provided.
