The Regular Meeting of the Town Board of the Town of Macedon held March 8, 2001 at the Town Complex, 30 Main Street, in the Village of Macedon, was called to order by Supervisor William E. Eddy at 7:30 p.m.

Pledge of Allegiance.

Upon Roll Call, the following members of the Board were present:

MRB discussed the options for the proposed highway garage wash system.  Pat Nicholetta will schedule appointments to observe the various options.  A site plan was discussed for the proposed 66’x40’ modular complex unit.  MRB will look into the regulations regarding elevators. The scope of services and fees was reviewed.

Councilperson Maul entered the meeting at 8:00 p.m.

8:00 PM – FORSAY/NORMAN – WEST WALWORTH ROAD – PROPERTY MAINTENANCE
The Town Board is in receipt of a memo from Mario Fioravanti dated February 7, 2001 regarding rat infestation.  Donald Forsay was served with a notice of hearing on February 19, 2001 and Suzanne Norman on February 21, 2001.

Anthony LaFay represented Donald Forsay before the Town Board.  Mr. LaFay stated that his client stores nothing that is eatable by rats on his property.  He stated that Mrs. Norman does not subscribe to trash pickup, has a compost pile and burns garbage in a barrel.  He feels that if there is an origin of something that draws rats or other rodents to the property it is on Mrs. Norman’s property.  From there they may migrate around.  He doesn’t believe anyone has reported seeing a rat, tracks have been reported.

Attorney Vilanti asked if Mr. Forsay would be amenable to allowing the building inspector or his designee onto his property to inspect it and to determine what is there and what steps might  need to be taken.
Attorney LaFay stated they did not have any objection to that as long as the inspection also concerns the other property specifically where they think the rats originate.   A copy of the notice to Mrs. Norman was provided to Attorney LaFay by the Clerk at his request.  Mr. Forsay is a NYS Certified Pesticide Applicator and has applied rat dope around all his properties.  He has not seen any rat bodies.  Attorney LaFay stated his client has no objection to an inspection but would like to be present when it is conducted.  He would like an objective third party present to report to the Board.

Suzanne Norman stated she does not have a compost pile.  She does burn paper.  Tracks were on both properties.  The source of the rats was from the northeast corner and southeast corner of the little barn.  Within a three-hour period 20 packs of rat poison were gone from Mr. Forsay’s property.  For three nights rat packs were put out and gone every morning.  Mrs. Norman also put rat packs on her property.  Not one was gone.

Attorney Vilanti asked if Mrs. Norman had any objections to an inspection by the building inspector or anyone he designates to inspect the premises and determine what, if any, actions need to be taken.

Attorney LaFay invites an inspection.  If there is an infestation they will take the steps to abate the problem.  Mr. Forsay has no intention of fighting the Town on that.

Councilperson Kenyon suggested a company be employed to provide an impartial evaluation of the situation.

The purpose of this hearing was to provide an opportunity for both sides to make statements.  The Board can consider everything that is said, the report of the building inspector and take what action it deems necessary.  The Town may wish to determine what is involved and the expense associated with it before it begins.  Whatever expense involved gets assessed through taxes against the properties.

Mrs. Norman has witnessed dump truck loads of insulation stored in the little barn.

Attorney Villani suggested the Board might wish to designate someone to go in, inspect it and see if there is a continuing problem.

8:30 PM – HARTZ – MACEDON CENTER ROAD – PROPERTY MAINTNENANCE

The Town Board is in receipt of memo from Mario Fioravanti dated February 16, 2001 regarding the burned out house at 1729 Macedon Center Road on the corner of Scott Road.  The property was damaged by fire approximately two years ago and is currently vacant.

No one was present regarding this matter.

The hearing was closed at 8:31 p.m.

Next week the engineers, building inspector and attorney will meet to discuss the elevator issue.

RESOLUTION NO. 89 (01)  HIGHWAY CLERK APPOINTMENT
WHEREAS the Highway Superintendent, Richard Roets, appoints Mary Beth Braman to the position of Part-Time Highway Clerk, 20 hours per week, effective March 12, 2001 be it further

RESOLVED that the Town Board establishes the rate of $8.20 per hour.

RESOLUTION NO. 90 (01)  HIGHWAY GARAGE-NEW FACILITY PROFESSIONAL SERVICES

BE IT RESOLVED that the Town of Macedon Town Board authorizes MRB Group, P.C. to prepare plans and specifications (contract documents) for Bidding and Construction Services as outlined in the proposal entitled “Town of Macedon Highway Garage-New Facility, O’Neill Road, Proposal for Professional Services” dated January 17, 2001 in the amount of $102,800 and be it further

RESOLVED that the Supervisor be authorized to execute the above referenced proposal for said services.
