TOWN OF MACEDON

PLANNING BOARD

August 5, 2019

 

 

PRESENT: Chairman Doug Allen, Members Mert Bartels, Kevin Rooney, Tom Morrison, Greg Whitney, and Suzanne Airy. Also present were Town Councilman David McEwen and Board Clerk Brandi Schutt. Absent were Town Engineer Scott Allen and Mark McEwen.

Chairman Doug Allen called the meeting to order at 7:30 p.m.

 

PUBLIC HEARINGS:

Motion made by Kevin Rooney to waive the reading of the legal notice, seconded by Tom Morrison. All in favor (McEwen absent); motion carried.

 

 

PB-10-19 Delaware River Solar Frey Road Subdivision

 

Motion made by Kevin Rooney to open the public hearing, seconded by Suzanne Airy. All in favor (McEwen); motion carried.

 

Dan Compitello was present to address any questions from the board.

 

Motion made by Kevin Rooney to close the public hearing, seconded by Greg Whitney. All in favor (McEwen absent); motion carried.

 

 

Z-05-19 Crowley 3164 Hance Road Setback Waiver

 

Motion made by Kevin Rooney to open the public hearing, seconded by Tom Morrison. All in favor (McEwen); motion carried.

 

Heather Crowley was present to address any questions from the board.

 

Motion made by Kevin Rooney to close the public hearing, seconded by Tom Morrison. All in favor (McEwen absent); motion carried.

 

 

OLD BUSINESS:

 

PB-10-19 Delaware River Solar Frey Road Subdivision

 

Dan Compitello explained that their solar project had already been approved in previous meetings and now the electric company is asking them to subdivide the parcel. They are required to have two separate systems on two separate lots. The parcel will be divided into 3 lots.

 

Motion made by Kevin Rooney to issue a negative declaration on SEQRA, seconded by Mert Bartels. All in favor (McEwen absent); motion carried.

 

Motion made by Kevin Rooney to grant subdivision approval, seconded by Greg Whitney. All in favor (McEwen absent); motion carried.

 

 

Z-05-19 Crowley 3164 Hance Road Setback Waiver

 

Town Engineer Scott Allen explained that the code states that if a parcel is zoned NCD then all variances must go through the Planning Board rather than the Zoning Board. The property owner Heather Crowley explained that she put in an above ground pool last year and she would like to add a deck in her rear yard that will be 3 feet from the property line. She also explained that she has an 8 foot fence running along her property line so the deck will not be visible to the public.

 

 

Motion made by Kevin Rooney to grant the waiver of a rear setback, seconded by Mert Bartels. All in favor (McEwen absent); motion carried.

 

 

ZBA REFFERAL:

 

Z-04-19 Flick 1158 Wilson Road Area Variance Section 135-162-B Front & Side Setback

 

Town Engineer Scott Allen explained that the applicant is looking to build a bigger garage and is looking for a variance for a side setback of 14 feet and a front setback of 41 feet.

 

A motion was made by Kevin Rooney, seconded by Greg Whitney, for a positive referral for front and side setbacks. All in favor (McEwen absent); motion carried.

 

MINUTES:

 

A motion to approve the 07-01-19 minutes was made by Mert Bartels, seconded by Suzanne Airy. All in favor (McEwen absent); motion carried.
