PLANNING BOARD

August 7, 2017

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Mert Bartels, Tom Morrison, Kevin Rooney and Greg Whitney. Also present were Town Councilman David McEwen, Town Engineer Scott Allen and Board Clerk Brandi Schutt.  Absent was Mark McEwen.

 

Chairman Allen called the meeting to order at 7:31 p.m.

 

 

PUBLIC HEARING:

 

PB-05-17 – Keller – Quaker Road – Industrial site plan – Preliminary & Final – A motion to open the public hearing was made by Kevin Rooney, seconded by Greg Whitney.  All in favor (McEwen absent); motion carried. There was no one to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor (McEwen absent); motion carried.

 

PB-06-17 – Laker Development Group, LLC – 531 R Route 31 – One-lot realty subdivision – A motion to open the public hearing was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor; motion carried. There was no one to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor (McEwen absent); motion carried.

 

 

NEW BUSINESS:

 

PB-07-17 – Moose – Monroe Wayne County Line Road – Residential site plans – Sketch plan approval – John Moose addressed the board on behalf of his parents who are the applicants.  He explained that his parents were looking to build a one story ranch style home that would bring them closer to him and where he lives since they are now currently in Lyons. Town Engineer Scott Allen commented that the plans far exceeded what was required for a sketch plan. A motion was made by Mert Bartels, seconded by Suzanne Airy, to approve the sketch plan. All in favor (McEwen absent); motion carried.

 

PB-08-17 – Airy Irrevocable Trust – 2616 Weidrick Road – Residential site plans – Sketch plan approval – Suzanne Airy recused herself from the discussion. Mike Greene from Greene Land Surveying was present to address the board. He explained that the applicant wanted to build a smaller home next to their existing home. The new residence would share a driveway with the existing residence. Town Engineer Scott Allen asked if this land was a part of the farmland preservation. Mr. Greene clarified that it was not and that the farmland preservation is the next part down under Airy Acres. Mr. Greene pointed out that they also maintained enough land off the south end of the barn to create another lot that meets all the guidelines. A motion was made by Greg Whitney, seconded by Tom Morrison, to approve the sketch plan. All in favor (McEwen absent); motion carried.

 

PB-09-17 – Vinnik – County Line Road – Residential site plans – Sketch plan approval – Mike Greene from Greene Land Surveying was present to address the board. He explained that this lot was a challenging site. He also mentioned that they were unsure of where the garage would be at this point. Town Engineer Scott Allen asked if the garage would be detached. Mr. Greene said that it would be. He also mentioned that the owner is going to need a lot of fill and grading for the lot.  A motion was made by Greg Whitney, seconded by Tom Morrison, to approve the sketch plan. All in favor (McEwen absent); motion carried.

 

PB-10-17 – Keller – 440 Wilkinson Road – Fill permit – Town Engineer Scott Allen explained the background regarding this application. He explained to the board that Joseph Keller owns two lots where he would like to level his land while his neighbor across the street is excavating a pond and will have “fill” to dispose of. The volume of fill was checked and is pretty accurate for the project proposed. Kevin Rooney asked if there is a driveway on one of the lots and Town Engineer Scott Allen responded that he was not aware of that. Kevin Rooney then asked about muddy trucks coming in and out of the lot and stated that they don’t want the fill to get all over the road. Town Engineer Scott Allen said that Mr. Keller should get a permit and put a driveway in, and Kevin Rooney added that Mr. Keller will have to get equipment in there to level the land anyways. A motion was made by Kevin Rooney, seconded by Suzanne Airy, to approve the fill permit under the conditions that Mr. Keller gets driveway permits from both Highway superintendents and no mud is tracked onto the road. All in favor (McEwen absent); motion carried.

 

 

OLD BUSINESS:

 

PB-05-17 – Keller – Quaker Road – Industrial site plan – Preliminary & Final – Mike Greene from Greene Land Surveying was present to address the board. He explained that Joseph Keller would like to build a 48’ by 64’ pole barn. Samples of the color of the structure were then passed around to the board members. Suzanne Airy asked if the color was a different blue than the existing building by the road and Town Engineer Scott Allen said it was a little different. Mr. Greene pointed out that the driveway was widened since the last meeting and Kevin Rooney commented that things could have gone bad with the previous driveway plan and he could have lost access. A motion for SEQR negative declaration was made by Kevin Rooney, seconded by Mert Bartels.  All in favor (McEwen absent); motion carried.  A motion was made by Kevin Rooney, seconded by Mert Bartels, to grant preliminary/final for the pole barn that was purposed.  All in favor (McEwen absent); motion carried.

 

PB-06-17 – Laker Development Group, LLC – 531 R Route 31 – One-lot realty subdivision – Daniel Bennett from Graystone Construction Management Services was present to speak on behalf of the applicant. The subdivision would be taking place behind Goodwill and will eventually bring in a solar project to the northern lot.  Laker Development Group would like to create a new tax parcel where the solar project will go. There are other plans for the lot closer to Route 31. Kevin Rooney asked if anyone at this time was going to expand the road. Town Engineer Scott Allen responded saying that they’re going to use the driveway off of North Wilson Road for access and a factory is in the works; which would require the road to be looped at a later date. Town Engineer Scott Allen commented that the loop would be a requirement of the project being worked on for the factory with a lot of employees and shift changes. Town Chairman Doug Allen asked where the looped road would go. Town Engineer Scott Allen said North Wilson Road will be continuous to Wayneport Road and Route 31.. Town Chairman Doug Allen commented that we couldn’t ask for a better location to put the solar project because it won’t be seen. Mert Bartels asked if Mr. Bennett’s solar projects are only in this area. Mr. Bennett explained that they have some in this area and also in Syracuse. A motion for SEQR negative declaration was made by Kevin Rooney, seconded by Greg Whitney. A motion was made by Kevin Rooney, seconded by Suzanne Airy, to approve the one-lot realty subdivision. All in favor (McEwen absent); motion carried.

 

 

ZBA REFERRAL:

 

Z-04-17 – Depew – 1010 Wayneport Road – Area Variance – Section 135-61-B-5 – Accessory structure in front yard– Town Engineer Scott Allen explained the background regarding this application. The applicant would like to build a second detached garage at an angle partly in their front yard due to the trees in the yard. Town Engineer Scott Allen commented that it was not a substantial variance but rather more aesthetic. A motion to give a positive referral to the ZBA was made by Kevin Rooney, seconded by Greg Whitney.  All in favor (McEwen absent); motion carried.

 

 

MINUTES:

 

A motion to approve the 07-05-17 minutes was made by Suzanne Airy, seconded by Greg Whitney.  All in favor (McEwen absent); minutes approved.
