PLANNING BOARD

February 23, 2015

 

 

PRESENT:  Members Suzanne Airy, Mert Bartels, Mark McEwen, Tom Morrison, Kevin Rooney and Greg Whitney.  Also present were Town Engineer Scott Allen, Town Councilman David McEwen (via Skype) and Board Clerk Susan Bush.  Absent was Chairman Doug Allen.

 

Vice Chairman Mert Bartels called the meeting to order at 7:35 p.m.  A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Greg Whitney.  All in favor (Allen absent); motion carried.

 

PUBLIC HEARING:

 

PB-03-14 – Auto Zone – Route 31 – Three (3) lot subdivision & commercial site plan – A motion to open the public hearing was made by Kevin Rooney, seconded by Greg Whitney.  All in favor (Allen absent); motion carried.  Joe Ardieta of Vanguard Engineering was present on behalf of the applicant.  One of the current property owners and their real estate broker were also present.  There was no one else to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Greg Whitney.  All in favor (Allen absent); motion carried.

 

Member Tom Morrison entered the meeting at 7:38 p.m.

 

OLD BUSINESS:

 

PB-03-14 – Auto Zone – Route 31 – Three (3) lot subdivision & commercial site plan – Preliminary & final – Joe Ardieta of Vanguard Engineering addressed the Board.   He explained the proposed site is on the southeast corner of Route 31 & Wayneport Road.  As requested at the last Board meeting, the faηade of the building has been changed from smooth face to split face, integral color block.  Mr. Ardieta stated he had received the Town Engineer’s recommendations and the physical changes have been made; easement boundaries and descriptions and the sewer petition will be coming; DOT approvals are still outstanding; revised SWPPP has been sent to Soil & Water.  The Town Engineer explained this is a relatively simple building and utilities; sewer extension is fairly short; storm water is all being handled on site.  He also suggested the Planning Board approval be conditioned upon receiving all outside agency approvals.  The Board members discussed the full access driveway onto Route 31, and Mr. Allen explained it would be incumbent upon the applicant to get DOT approval and the work permit.  The proposed use would be an improvement over the previous use as a multi-unit motel.

 

A motion for negative SEQR declaration was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor (Allen absent); motion carried.  A motion was made by Kevin Rooney, seconded by Greg Whitney,  to grant preliminary and final three (3) lot realty subdivision and commercial site plan for Auto Zone (Lot #1) subject to the following conditions:

1)      Obtaining necessary outside approvals from NYS DOT, NYS DEC, Wayne County

Highway Dept., Wayne County Water & Sewer Authority, NYS Dept. of Health &

SWPPP review by Ontario County Soil & Water;

2)   Building exterior to be three-color split face, integral color block;

3)   Obtaining sewer district extension approval from the Macedon Town Board.

 

All in favor (Allen absent); motion carried.

 

NEW BUSINESS:

 

PB-02-15 – Rodriguez – 3139 Walworth Road – Home occupation – Applicant Josι Rodriguez addressed the Board regarding this request.  He has recently purchased a home at 3139 Walworth Road and would like approval for a home occupation as a gunsmith.  He performs minor gun repairs, coating & refinishing in his spare time.  He has a license from ATF to perform this work and is in the process of transferring his license from his previous address in Walworth to his new home in Macedon.  He will use a portion of one of the existing garages as his shop.  There are no other employees.  There will be very little traffic generated as he usually picks up and delivers items to be repaired.  He has a “loop” driveway with two entrances which would provide adequate parking for the occasional client who may drop off or pick up items.  Any ammo stored on-site would be his personal property; no ammo sales would take place.  Mr. Rodriquez also stated that if his request is approved, the ATF would need a letter of approval from the Town.  A motion was made by Mark McEwen, seconded by Suzanne Airy, to approve a home occupation for Rodriguez at 3139 Walworth Road as submitted.  All in favor (Allen absent); motion approved.

 

LOG-IN:

 

PB-01-15 – Crane – 815 Route 31 – Change of use – This property is zoned ORM (Office-Research-Manufacturing).  It is currently a residence but the owner proposes converting it into a small distillery, including production, tasting room and retail sales.  The front portion of the existing residence will be removed, leaving a newer rear addition and garage to be used for all aspects of the distillery.  As the business expands, they would like to renovate the old barn and move the production operation there.  This change of use would take the property from non-conforming (residential) to conforming (manufacturing).

 

ZBA REFERRAL:

 

Z-02-15 – Lakeview Health Services – 1936 Route 31 – Area Variance – Section 135-85 (Schedule I) – Route 31 setback – Town Engineer Scott Allen explained this applicant has received their Special Use approval from the Town Board.  In the process of refining their submission, the proposed site plan was changed, moving the building closer to Route 31.  The Planning Board will review this request at their next meeting.

 

MINUTES:

 

The 02-09-15 minutes could not be approved due to lack of appropriate quorum.
