TOWN OF MACEDON

PLANNING BOARD

December 9, 2013

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Mert Bartels, Mark McEwen, Tom Morrison, Kevin Rooney and Greg Whitney.  Also present were Town Engineer Scott Allen, Town Councilman David McEwen (via Skype) and Board Clerk Susan Bush.

 

Chairman Allen called the meeting to order at 7:30 p.m.  A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

PUBLIC HEARING:

 

PB-12-13 – Tim Hortons USA – Route 31 & Sampson Drive – Commercial site plan (restaurant) – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.  Dan Blamowski of Tim Hortons and Adam Fishel of Marathon Engineering were present on behalf of the applicant.  A Macedon resident was present and asked for clarification on the Special Use Permit and General Commercial zoning.  The resident also stated he felt this business would be a good addition to the community.  There was no one else present to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

OLD BUSINESS:

 

PB-12-13 – Tim Hortons USA – Route 31 & Sampson Drive – Commercial site plan (restaurant) – Preliminary & final - Dan Blamowski of Tim Hortons reviewed the changes made to the site plan since the previous meeting:

 

·        Building style – Hipped-roof, residential style; mechanical units on roof will be hidden;

cooler mechanicals will be hidden; stone added around base of building.

·        Landscaping – Added beds in front (Route 31) & trees in back (Sampson Drive).

·        Dumpster enclosure – Exterior will match exterior of the building & the gates will be

solid, dark-stained wood.

·        Lighting – LED lights; black finish on poles & light heads; no light spillage over property lines.

·        Signs – One pylon in front of building (similar to that of CVS); one building sign.

 

Board members also discussed the need for more illumination on the northwest corner of the property (Sampson Drive/Walmart driveway).  Mr. Blamowski will revise the plan to add another light and/or relocate a pole light to that area.

 

A motion for negative SEQR declaration was made by Mark McEwen, seconded by Kevin Rooney.  It was noted that this site had previously been approved for a gas station, and the impacts of this application are far less than that previously approved use.  All in favor; motion carried.  A motion was made by Kevin Rooney, seconded by Greg Whitney, to grant preliminary and final site plan approval for Tim Hortons USA, Tax Parcel 61111-00-386763, conditioned upon Town Board approval of a Special Use Permit and any other outstanding approvals.  All in favor; motion carried.

 

TOWN BOARD REFERRAL:

 

Tim Hortons USA – Route 31 & Sampson Drive – Mr. Blamowski clarified the hours of operation for this store would be 24 hrs./7 days a week.  A motion was made by Kevin Rooney, seconded by Tom Morrison, to give the Town Board a positive recommendation for this Special Use Permit.  All in favor; motion carried.

 

MINUTES:

 

A motion to approve the 11-25-13 minutes was made by Mert Bartels, seconded by Suzanne Airy.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by Suzanne Airy, seconded by Mark McEwen.  All in favor; meeting adjourned at 8:02 p.m.
