PLANNING BOARD

April 8, 2013

 

 

PRESENT:  Vice Chairman Mert Bartels and members Suzanne Airy, Mark McEwen, Tom Morrison, Kevin Rooney and Greg Whitney.  Also present were Town Engineer Scott Allen and Board Clerk Susan Bush.  Absent were Chairman Doug Allen and Town Councilman David McEwen.

 

Vice Chairman Bartels called the meeting to order at 7:30 p.m.  A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor (Allen absent); motion carried.

 

PUBLIC HEARING:

 

PB-05-13 – Gambino – Route 31 (rear) east of West Wayne Plaza – Industrial/commercial site plan – A motion to open the public hearing was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor (Allen absent); motion carried.  Fred Shelley of Shelley Associates was present on behalf of the applicant.  There was no one else present to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor (Allen absent); motion carried.

 

OLD BUSINESS:

 

PB-05-13 – Gambino – Route 31 (rear) east of West Wayne Plaza – Industrial/commercial site plan – Preliminary & final – Fred Shelley, Shelley Associates, reviewed this site plan.  The applicant owns a “green” spray foam insulation business and would like to build a new facility on a vacant parcel behind the old McDonald’s restaurant.  They are proposing a 30 ft. x 40 ft. building with white vinyl siding to be used for storage and office space.  Four (4) parking spaces are planned on each side of the lot (one space designated as handicapped) with landscaping installed around the building and in the front yard.  There may be a small amount of outside storage behind the building.  Mr. Shelley was aware of the Wayne County Planning Board comments, and they have been addressed.  The Board then discussed paved vs. unpaved parking lot, covered building entry, lawn areas and exterior siding.  The following conditions were agreed upon:   (1) Driveway/parking areas should be paved from the access road to the front of the building; (2) Building should have a covered entryway; (3) Lawn/mowed areas should be delineated on the site plan (at least 50 ft. along the road and around the landscaping beds); (4) Building exterior should be bi-colored (4 ft. “wainscoting”) on three (3) sides (front & ends).  A motion for negative SEQR declaration was made by Kevin Rooney, seconded by Greg Whitney.  All in favor (Allen absent); motion carried.  A motion was made by Kevin Rooney, seconded by Greg Whitney, to grant preliminary & final site plan approval, subject to the conditions agreed upon.  All in favor (Allen absent); motion carried.

 

NEW BUSINESS:

 

PB-06-13 – Luong – 1399 Victor Road – Home occupation (dog grooming) – Madeline Luong was present to explain her request.  She is an experienced dog groomer and would like to start her own business at home.  There is a garage room off the back of her house with its own entrance which she would like to dedicate to this purpose.  She expects 3 to 5 clients a day; there would be no boarding or overnights for any client pets; there will be no other employees.  Ms. Luong stated there is no State licensing required; however, the Town Engineer indicated the business would be subject to fire/safety inspections.  The hours of operation will be Monday to Saturday from 10:00 a.m. to 5:00 p.m. by appointment.  The existing driveway has adequate space to accommodate customer vehicles and provides a turnaround area.  The applicant indicated she would like to have a sign so that clients will be able to locate her business.  A motion was made by Tom Morrison, seconded by Kevin Rooney, to approve this home occupation subject to the following conditions:  (1) Space dedicated to the business will be less than 200 sq. ft.; (2) Hours of operation will be Monday to Saturday from 10:00 a.m. to 5:00 p.m.; (3) No boarding or overnight stays for client pets; (4) Sign subject to Town Code requirements.  All in favor (Allen absent); motion carried.

 

PB-07-13 – Ward – 3111 Hance Road – Home occupation (hair salon) – The applicant was not present at the meeting.  However, a neighbor was in attendance and expressed a concern regarding the applicant’s dogs.  There have been past problems with the applicant’s dogs barking for long periods of time, and the neighbor’s concern was that the dogs would be kept outside in the yard during business hours, leading to a recurrence of the barking problem.  The neighbor had no objections to the business, just concerns about how the pet situation would be handled.  Because the applicant was not present, the Board deferred further discussion until the next meeting and requested the Board Clerk contact Ms. Ward to confirm her attendance at that time.

 

ZBA REFERRAL:

 

Z-02-13 – Lawler – Kittering Road – Area Variance – Section 135-61-B-5 – Accessory structure in front yard – Board had no concerns about this request.

 

MINUTES:

 

A motion to approve the 03-11-13 minutes was made by Tom Morrison, seconded by Greg Whitney.  All in favor (Allen absent); minutes approved.

A motion to adjourn the meeting was made by Suzanne Airy, seconded by Greg Whitney.  All in favor (Allen absent); meeting adjourned at 8:36 p.m.
