PLANNING BOARD

June 13, 2011

 

 

PRESENT:  Vice Chairman Mert Bartels, members Suzanne Airy, Mark McEwen, Tom Morrison, Kevin Rooney & Greg Whitney.  Also present were Councilman David McEwen, Town Engineer Scott Allen and Board Clerk Susan Bush.  Absent was Doug Allen.

 

Vice Chairman Bartels called the meeting to order at 7:30 p.m.  A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Tom Morrison.  All in favor; motion carried.

 

PUBLIC HEARING:

 

PB-04-11 – Hilton – Walworth/Barnes Roads – One-lot realty subdivision – A motion to open the public hearing was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor; motion carried.  Applicant Harlan Hilton was present to explain his request.  There was no one else to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Tom Morrison.  All in favor; motion carried.

 

LOG-IN & NEW BUSINESS:

 

PB-04-11 – Hilton – Walworth/Barnes Roads – One-lot realty subdivision – Log-in, preliminary & final – Applicant Harlan Hilton explained his plan to subdivide a 94+ acre parcel that encompasses both sides of Barnes Road.  Lot 1 on the north side of Barnes Road, including the homestead, will be 57+ acres, and Lot 2 on the south side will be 37+ acres.  Pending subdivision approval, the Hiltons intend to sell Lot 2 and two other parcels on the south side of Barnes Road to another farmer.  The applicant’s property is part of the State/Federal/Town agricultural conservation program, and approval from the easement holders will be required prior to sale of the land.  The Town Board will handle the Town’s interest in the conservation easement transfer; Planning Board action is for subdivision purposes only.  A motion for a negative SEQR declaration was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor; motion carried.  A motion was made by Kevin Rooney, seconded by Suzanne Airy, to grant preliminary/final approval for a one-lot subdivision as presented, subject to agricultural easement transfer agreement among the interested parties.  All in favor; motion carried.

 

TOWN BOARD REFERRAL:

 

PB-05-11 – Pease – 590 Frey Road – Expansion of non-conforming use – Applicant Scott Pease was present to address the Board.  He is purchasing 590 Frey Road which has an existing mobile home.  He would like to remove that unit, which is in very bad condition, and replace it with a newer, larger model.  The zoning for this area is General Commercial, and the existing mobile home is considered a legal pre-existing, non-conforming use.  To replace the current home with a larger one will require Town Board approval for expansion of a non-conforming use.  Mr. Pease explained a mobile home would not be out of character for the neighborhood as there are several others on Frey Road.   A motion for a positive recommendation to the Town Board was made by Kevin Rooney, seconded by Tom Morrison.  All in favor; motion carried.

 

ZBA REFERRALS:

 

Z-02-11 – Paul – 855 Farmington Road – Area Variance – Sections 135-64-J-1 & 4 – In-law apartment larger than allowed with separate utility meter – Board gave a positive referral.

 

Z-03-11 – Datta/Central Sign & Crane – 2400 Route 350 – Area Variance – Sections 135-190-A, C, E – Number and size of signs – Board had no concerns with this request and felt the change could be an improvement.

 

MINUTES:

 

A motion to approve the 04-25-11 minutes was made by Suzanne Airy, seconded by Kevin Rooney.  All in favor; minutes approved.

A motion to adjourn was made by Kevin Rooney, seconded by Tom Morrison.  All in favor; meeting adjourned at 8:00 p.m.
