PLANNING BOARD

July 12, 2010

 

 

PRESENT:  Chairman Doug Allen, members Mert Bartels, Tom Morrison, Kevin Rooney & Greg Whitney.  Also present were Town Councilman David McEwen, Town Engineer Scott Allen and Board Clerk Susan Bush.  Absent were members Suzanne Airy and Mark McEwen.

 

Chairman Allen called the meeting to order at 7:32 p.m.  A motion to waive reading the Legal Notice was made by Mert Bartels, seconded by Kevin Rooney.  All in favor; motion carried.

 

PUBLIC HEARINGS:

 

PB-06-10 – Deys708 Victor Road – One-lot realty subdivision – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.  Applicant Richard Deys and his son David Bruinix were present to speak before the Board.  There was no one else present to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

PB-07-10 – Meyer – 2965 Walworth Road – Residential wind turbine – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.  Lane Young from O’Connell Electric was present to address the Board on behalf of his client Paul Meyer.  There was no one else present to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

NEW BUSINESS:

 

Councilman McEwen entered the meeting at 7:35 p.m.

 

PB-06-10 – Deys708 Victor Road – One-lot realty subdivision – This is a 9+ acre lot containing two residences.  The applicant would like to subdivide the property into two lots with a single residence on each.  Lot 1 will be approximately 5 acres with the older residence (applicant’s son), and Lot 2 will be approximately 4 acres with the log home of the applicant.  Subdivision lines will not interfere with the existing septic systems, and the mylar will be revised to show the septic locations.  A motion for negative SEQR declaration was made by Mert Bartels, seconded by Kevin Rooney.  All in favor; motion carried.  A motion was made by Kevin Rooney, seconded by Mert Bartels, to grant preliminary/final realty subdivision for Deys for two lots on Victor Road with map revision for septic locations.  All in favor; motion carried.

 

PB-07-10 – Meyer – 2965 Walworth Road – Residential wind turbine – Lane Young, Project Manager for O’Connell Electric, explained this application to the Board.  His company has installed various wind turbines across New York State.  The applicant’s lot is 6.72 acres, and open fields around the proposed tower site will allow unimpeded wind flow.  Mr. Young presented an amendment to the original submission clarifying that the turbine will meet the Town’s 75 ft. height limit.  He also explained this tower will not qualify for a NYSERDA rebate as those requirements have been revised; i.e., blades must be 30 ft. above any obstruction within a 500 ft. radius.  Board then discussed the turbine specifications for min./max. wind speeds, braking, maintenance, cost and life span.  This will be a grid connect system, and excess power will be sold back to the utility company.  With the height correction, this wind turbine meets Code requirements.  Kevin Rooney, who is also a member of the Wayne County Planning Board, stated there have been similar applications throughout the County.  A motion for negative SEQR declaration was made by Kevin Rooney, seconded by Tom Morrison.  All in favor; motion carried.  A motion was made by Kevin Rooney, seconded by Mert Bartels, to grant approval for a residential wind turbine for Meyer.  All in favor; motion carried.

 

MINUTES:

 

A motion to approve the 05-12-10 minutes was made by Mert Bartels, seconded by Kevin Rooney.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; meeting adjourned at 8:28 p.m.
