TOWN OF MACEDON

PLANNING BOARD

October 12, 2009

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Mert Bartels, Tom Morrison and Kevin Rooney.  Also present were Town Councilwoman Sandy Pagano, Town Engineer Scott Allen and Board Clerk Susan Bush.  Absent was Mark McEwen.

 

Chairman Allen called the meeting to order at 7:30 p.m.  A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

PUBLIC HEARINGS:

 

PB-16-09 – Morrison – Leno Road – One-lot realty subdivision & residential site plan – Note:  Due to a conflict of interest, Tom Morrison recused himself from all discussion and voting on this matter.  A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor (Morrison recused); motion carried.  Applicants Kenneth & Patricia Morrison and their engineer, David Matthews of Shelley Associates, were present.  There was no one else to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor (Morrison recused); motion carried.

 

PB-17-09 – Jensen – 965 Farmington Road – Commercial riding/boarding stable – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.  Applicants Chris & Louise Jensen and their daughter, Kristine Ventura, were present.  There was no one else to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

OLD BUSINESS:

 

PB-16-09 – Morrison – Leno Road – One-lot realty subdivision & residential site plan – Preliminary & final – Note:  Due to a conflict of interest, Tom Morrison recused himself from all discussion and voting on this matter.  Engineer Dave Matthews of Shelley Associates reviewed the application.  This is the subdivision of approximately 2.2 acres from a 77 acre parcel on the south side of Leno Road with a single-family residence on the new lot.  An underground telecommunications cable has been located and staked.  House will be sited 15 ft. away from the cable (10 ft. minimum required).  Cable is 4 to 4-1/2 ft. deep with 3 ft. of clearance between septic line & cable.  A motion for negative SEQR declaration was made by Kevin Rooney, seconded by Mert Bartels.  All in favor (Morrison recused); motion carried.  A motion to grant subdivision and preliminary/final site plan approval was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor (Morrison recused); motion carried.

 

NEW BUSINESS:

 

PB-17-09 – Jensen – 965 Farmington – Commercial riding/boarding stable – Mr. & Mrs. Jensen and their daughter, Kristy Ventura, reviewed their plans for a commercial stable.  An existing barn on the property houses six (6) horses, and they would like to build a second barn (72’ x 152’) to house eight (8) additional horses with an indoor riding arena.  Client horses will be boarded and riding lessons will be given.  The Jensens previously operated a successful stable in Perinton and would like to have a similar operation in Macedon, but on a much smaller scale.  They hope to have eight (8) owned (lesson) horses and six (6) boarders.  The existing barn and house are not visible from the road; new barn will be partially visible.  The driveway has been oiled and stoned during the summer, which will reduce dust from any additional traffic.  No public horse shows will be held; events will be limited to their students and boarders.  Any activity beyond that scope will require further Planning Board approval.  Applicants indicated they had spoken with the residents on either side of the driveway and have received their support.  Board members discussed the width of the driveway (12+ ft.) questioning emergency vehicle access and whether two vehicles could pass each other.  Board members requested Town Engineer Scott Allen check the driveway before a building permit is issued.  A motion for negative SEQR declaration was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor; motion carried.  A motion was made by Kevin Rooney, seconded by Mert Bartels, to approve a commercial riding/boarding stable (14 stalls) subject to the condition that horse shows are limited to boarders and lesson horses (no outside participants) and the driveway is adequate to allow two vehicles to pass each other.  All in favor; motion carried.

 

MINUTES:

 

A motion to approve the 09-14-09 minutes was made by Mert Bartels, seconded by Kevin Rooney.  All in favor; motion carried.

 

OTHER BUSINESS:

 

Individual interviews of six (6) candidates for the open Board seat were conducted.  Town Councilwoman Sandy Pagano will relay a recommendation to the Town Board.

A motion to adjourn was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; meeting adjourned at 9:20 p.m.
