PLANNING BOARD

July 23, 2007

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Mert Bartels, Mark McEwen, Tom Morrison and Kevin Rooney.  Also present were Councilman Ken Nawrocki, Town Engineer Scott Allen, Town Attorney Anthony Villani and Board Clerk Susan Bush.  Absent was Brian Gagne.

 

Chairman Allen called the meeting to order at 7:30 p.m.

 

TOWN BOARD REFERRAL:

 

Waste Management/High Acres – Wayneport & Quaker Roads – Special Use Permit – Landfill expansion – Present on behalf of the applicant were:  Jeff Kocian of Waste Management, Luann Meyer & David Belaskas of Stantec, Todd Farmen of Arcadis BBL, and Joe Picciotti of Harris, Beach.  Mr. Kocian gave a brief history of the existing landfill in Perinton.  The proposed expansion would be a total of 144± acres with 138.5 in Macedon and 5 in Perinton.  Waste Management currently has a Special Use permit for their leaf composting & wood recycling operation on Wayneport Road.  Ms. Meyer reviewed the timeline of this application from May, 2005, to the present.  DEC has been the lead agency with their statement of findings issued in May, 2007.  Intent of the expansion is to extend the duration/life of the landfill.  There will be no change in daily intake, source of material and hours of operation.  Access will remain where it is at present.  Waste Management operates three solid waste landfills and one hazardous waste facility in New York State.  No hazardous waste is accepted at High Acres.

 

Due to the 50+ year lifespan expected with the expansion and the difficulty of planning over that time, Mr. Kocian stated Waste Management has agreed to five-year increments on the Special Use permit.  Permits will also be required from other agencies including DEC and the Army Corps.  Should governing regulations become more stringent in the future, the State has the right to make Waste Management adhere to any new standards.  There is a DEC staff monitor on site doing daily inspections.  For 30 years after closure, Waste Management must monitor, maintain and repair the site, if necessary, with financial guarantees being made.

 

Other issues discussed were:  Geology of the landfill, cell planning & construction, permitted height, cover materials, odor, gas collection (power generation & “flaring”), noise levels, leachates, viewshed, wetland mitigation, buffer properties, reforestation, truck routes and an overview of host community benefits.

 

Tom Morrison expressed concern regarding the buffering on the east side of the drumlin along the west side of Wayneport Road and would like to see plantings (possibly hardwoods) begun as soon as possible.  Scott Allen indicated this could also be a consideration during the review process every five years.

 

A motion was made by Mert Bartels, seconded by Kevin Rooney, for a positive referral to the Town Board per the attached Special Use Permit Advisory Review.  A roll vote of the members was taken as follows:  Airy – yes; Bartels – yes; Gagne – absent; McEwen – yes; Morrison – abstain; Rooney – yes; D. Allen – yes.  Therefore, this resolution is passed.

 

ZBA REFERRALS:

 

Z-11-07 – Filer’s Power Sports – 1136 Route 31 – Area Variance – Sections 135-190-A, C, E, F – Number of signs, size & location of ground sign – Board members felt sign was out of scale (too large) and gave a negative referral.

 

Z-12-07 – Brasser – 2727 Walworth Road – Area Variance – Section 135 Schedule I (Attachment 1) – Side setback for addition – Board gave a positive referral.

A motion to approve the 07-09-07 minutes was made by Kevin Rooney, seconded by Mark McEwen.  All in favor; minutes approved.

Special Use Permit Advisory Review

Town of Macedon Planning Board

 

Waste Management – High Acres Landfill and Recycling Center

Parkway Expansion Phase III

July 23, 2007

 

Whereas, Waste Management of New York, L.L.C. (WMNY) owns properties within the Town of Macedon bounded by the Wayne/Monroe County Line on the west, Quaker Road on the north, Wayneport Road on the east, and the Erie Canal/CSX railroad on the south, totaling approximately 220 acres, and

Whereas, WMNY has applied to the Macedon Town Board requesting a Special Use Permit, which would permit the expansion of the High Acres Landfill and Recycling Center (HALRC) within the properties described above within the Town of Macedon, and

Whereas, the proposed expansion of the HALRC is partially within the Town of Perinton in Monroe County, and partially within the Town of Macedon in Wayne County, and

Whereas, the Town of Macedon, the Town of Perinton, and other involved agencies mutually agreed to allow the New York State Department of Environmental Conservation (NYSDEC) to act as lead agent in a coordinated SEQRA environmental impact review process, and

Whereas the NYSDEC conducted a comprehensive SEQRA review for the Applicant’s total requested full build out condition of the landfill site, including a total operating landfill footprint of 138.5 acres in the Town of Macedon, with an additional 33 acres of undeveloped land utilized for support operations (i.e. roadways berms and sedimentation basins), extending to a maximum elevation height of 799 feet mean sea level, and

Whereas, the NYSDEC issued findings relative to the Final EIS on May 18, 2007, indicating that all environmental impacts relative to the proposed action have been mitigated to the extent possible, and

Whereas, the proposed project constitutes an extension of the lifespan of the existing High Acres Landfill facility, but does not constitute any change in daily operations, including tonnage accepted per day, hours of operation or other operational factors, and

Whereas, the Macedon Town Board referred the Special Use Permit application to the Macedon Town Planning Board at their July 12, 2007 meeting, and

Whereas, Town of Macedon Planning Board is required pursuant to Town Zoning Law §135-13-F to “review the application and submit a written report to the Town Board….”, and

Whereas, the Town of Macedon Planning Board Board is familiar with the existing HALRC property and the area proposed for the expansion thereof, and has thoroughly reviewed the Special Use Permit Application and SEQRA documents relative to this application, and

Whereas, the Town of Macedon Planning Board did perform an advisory review of the proposed Special Use Permit application on July 23, 2007.

Now therefore be it resolved, that the Macedon Town Board Planning Board hereby relies upon and adopts the SEQRA findings made by the NYSDEC, and

Be it further resolved, that the Macedon Town Planning Board hereby offers a positive referral to the Town Board upon the Applicant meeting all requirements of Town Zoning Section 135-182.2, and recommends that the Special Use Permit for WMNY to operate a Solid Waste Landfill be granted, subject to any conditions the Town Board deems necessary to protect the public health, safety and welfare, and

Be it further resolved, that the Macedon Town Planning Board recommends that special attention be given by WMNY to a reforestation plan for the east side of the drumlin on the west side of Wayneport Road with review on a five-year basis, and

Be it further resolved, that this resolution shall constitute the report from the Planning Board to the Town Board, as required by Town Zoning Law §135-13-F.
