PLANNING BOARD

April 23, 2007

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Mark McEwen & Tom Morrison.  Also present were Councilman Ken Nawrocki, Town Engineer Scott Allen and Board Clerk Susan Bush.  Absent were Mert Bartels, Brian Gagne and Kevin Rooney.

 

Chairman Allen called the meeting to order at 7:39 p.m.

 

OLD BUSINESS:

 

PB-03-07 – Lyons National Bank – Route 31 – Commercial site plan – Preliminary & final – Jim Sprague, Fisher Associates, was present to review changes made to the site plan.  A meeting was held with NYS DOT, and approval has been given for a full access driveway onto Route 31 instead of right in/right out.  A 2 ft. berm has been added across the front with landscaping and street trees.  Applicant is working with WCWSA on grading plan to determine depth of water main.  Top elevation will be 533/532 ft., which is consistent with the cross-access agreement with Wal-Mart.  This should not affect the Wal-Mart landscaping already installed.  Requested storm water management changes have been made.  Town Engineer was satisfied with landscaping, and stated site plan concerns have been addressed.  A motion for negative SEQR declaration was made by Mark McEwen, seconded by Suzanne Airy.  All in favor; motion carried.  The sign package was then reviewed.  Mr. McEwen questioned the need for the sign at the Wal-Mart driveway.  A motion was made by Mark McEwen, seconded by Suzanne Airy, to approve the sign package as submitted, pursuant to ZBA approval and previous positive referral by the Planning Board.  All in favor; motion carried.  A motion to grant preliminary & final site plan approval for Lyons National Bank was made by Tom Morrison, seconded by Mark McEwen.  All in favor; motion carried.

 

 

NEW BUSINESS:

 

Subway – 425 Route 31 (Wal-Mart) – Sign – Joe Franch, Subway Development of Western NY, was present to review this application.  The franchisee has changed since original submission, and Mr. Franch will be the operator of the Wal-Mart location.  Planning Board approval for this sign must be given prior to a permit being issued, even though a variance had been granted by the ZBA.  The Subway sign would be an additional 20 sq. ft. sign on the front of the Wal-Mart building near the grocery entrance and above the existing “Deli” sign.  Mr. Franch indicated there are Subways in the Brockport & Henrietta Wal-Marts.  The Henrietta store does not have an external Subway sign, nor does the Canandaigua Wal-Mart have a sign for its Dunkin’ Donuts.  Board members felt approving this sign would set an unfavorable precedent for other tenants within Wal-Mart and for future projects.  The Planning Board gave a negative referral to the ZBA in February.  A motion was made by Mark McEwen, seconded by Suzanne Airy, to approve the issuance of a sign permit as presented by Kasa Enterprises (Subway).  A roll vote was taken as follows:  Airy – no; McEwen – no; Morrison – no; D. Allen – no.  Therefore, this permit was denied.

 

 

ZBA REFERRAL:

 

Z-05-07 – Benedict – 927 Turner Road – Area Variance – Section 135 Schedule I (Attachment 1) – Side setback – Board gave a positive referral.

 

 

LOG-IN:

 

PB-07-07 – Camp – Barnes Road – Realty subdivision

 

 

MINUTES:

 

The 04-09-07 minutes could not be approved due to lack of proper quorum.
