PLANNING BOARD

November 14, 2005

 

PRESENT: Chairman Doug Allen, members Tom Ferreri, Mark McEwen and Kevin Rooney. Also present were Town Engineer Scott Allen and Councilman Ken Nawrocki. Absent were Mert Bartels, Brian Gagne and Tom Morrison.

Chairman Allen called the meeting to order at 8:12 p.m. Motion made by Kevin Rooney, seconded by Mark McEwen, to waive reading the legal notice as it appeared in the Times. All in favor; motion carried.

PUBLIC HEARINGS:

PB-15-05 - Kohmescher-Honan (Forsay) - West Walworth Road - 3-lot realty subdivision - Motion to open the public hearing made by Kevin Rooney, seconded by Mark McEwen. All in favor; motion carried. Michael Venturo of Popli Consulting was present on behalf of the applicant. There was no one else present to speak for or against this application. Motion made by Kevin Rooney, seconded by Mark McEwen, to close the public hearing. All in favor; motion carried.

PB-16-05 - Park Woods, LLC/Pecora - Canandaigua Road - 2-lot realty subdivision - Motion to open the public hearing made by Kevin Rooney, seconded by Mark McEwen. All in favor; motion carried. Mark Welker of Park Woods was present on behalf of both applicants. There was no one else present to speak for or against the application. Motion made by Kevin Rooney, seconded by Mark McEwen, to close the public hearing. All in favor; motion carried.

OLD BUSINESS:

PB-15-05 - Kohmescher-Honan (Forsay) - West Walworth Road - 3-lot realty subdivision - Preliminary & final - Michael Venturo of Popli Consulting explained changes in lot sizes previously requested by the Town Board regarding the Land Use waiver for width/depth ratio. At the Town Board meeting, Mr. Forsay had stated the property was now owned by his corporation (Friedeveld, Inc.), and Mr. Venturo presented documents confirming that transfer. Mr. Venturo asked the Planning Board to grant subdivision contingent upon the Town Board's waiver approval. After discussion, a motion was made by Kevin Rooney, seconded by Mark McEwen, for negative SEQR declaration. All in favor; motion carried. Motion to grant 3-lot realty subdivision subject to the Town Board's waiver of the Land Use Regulation for width to depth ratio made by Kevin Rooney, seconded by Mark McEwen. All in favor; motion carried.

PB-16-05 - Park Woods, LLC/Pecora - Canandaigua Road - 2-lot realty subdivision - Preliminary & final - Mark Welker explained this is a land swap of 7.0 acres from Park Woods to Pecora and 4.85 acres from Pecora to Park Woods. If approved, Park Woods would be making application to expand TPD zoning to include the new area for construction of patio homes. Mr. Pecora's area would be added to his farm. Motion for negative SEQR declaration made by Kevin Rooney, seconded by Mark McEwen. All in favor; motion carried. Motion made by Kevin Rooney, seconded by Mark McEwen, to grant approval of this realty subdivision and land swap between Park Woods, LLC and Pecora. All in favor; motion carried.

PB-14-05 - Waterford Land Development LLC (Hidden Woods Section I) - Wayneport Road - Realty subdivision & residential site plans - 15 lots - Preliminary & final - Bob Cantwell of BME Associates was present on behalf of the applicant. Town Engineer's Review Letter was discussed. Length of the two cul-de-sacs was discussed. Due to drainage implications and numerous reviews by the Planning Board and Town Board during rezoning, it was felt the plans as submitted should be approved. WCWSA has requested the water lines be looped back onto Wayneport Road. Applicant and WCWSA should reach agreement on this item. Board also requested the applicant to obtain agreement from adjoining property owners who will receive 30 ft. land strips connecting their properties to Wayneport Road. Motion made by Kevin Rooney, seconded by Mark McEwen, for negative declaration on long-form SEQR for the 47-lot realty subdivision. All in favor; motion carried. Motion made by Kevin Rooney, seconded by Mark McEwen, to grant preliminary approval for 47-lot realty subdivision. All in favor; motion carried. Motion made by Kevin Rooney, seconded by Mark McEwen, to grant preliminary & final approval for 15-lot realty subdivision and single-family residential site plans subject to Town Engineer's Review Letter. All in favor; motion carried.

TOWN BOARD REFERRAL:

Harv's Harley-Davidson/Wyman - 3120 Kittering Road - Expansion of non-conforming use - Kim Wyman was present to explain this application for replacement of an existing 18' x 32' storage building with a 50' x 64' pole building. New building will be 66 ft. off the road and will align with the road and the existing building. Councilman Nawrocki stated the Town Board had no issues with this plan. Motion made by Kevin Rooney, seconded by Mark McEwen, for a positive recommendation to the Town Board. All in favor; motion carried.

OTHER BUSINESS:

Cauwels/Magnum Auto Parts - 2620 Route 31 - Previous site plan review - Jonathan Cauwels was present to review his plans for this site. Board reviewed the original minutes granting this approval. Building will be 60' x 100' with 4'-5' brick/split-face block knee wall continuing around the windows, and the upper portion of the building will be blue. Due to very old fill, footers will go 12 ft. deep to virgin ground. Drainage easement has been given to the Town. Mr. Cauwels would like to begin construction in January. Board members saw no plan changes and had no concerns regarding the project.

 

 

 

MINUTES:

The 10-24-05 minutes could not be approved due to lack of correct quorum.
