PLANNING BOARD

September 12, 2005

 

PRESENT: Chairman Doug Allen, members Brian Gagne, Tom Morrison and Kevin Rooney. Also present were Councilman Ken Nawrocki and Town Engineer Scott Allen. Absent were Mert Bartels, Tom Ferreri and Mark McEwen.

Chairman Allen called the meeting to order at 7:30 p.m. Motion made by Brian Gagne, seconded by Kevin Rooney, to waive reading the legal notice as it appeared in the Times. All in favor; motion carried.

PUBLIC HEARINGS:

PB-11-05 - DeHollander - Pannell Road - Subdivision and single-family residential site plans - 3 lots - Motion to open the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. Scott DeHollander was present to explain this application. There was no one else present to speak for or against this application. Motion made by Brian Gagne, seconded by Kevin Rooney, to close the public hearing. All in favor; motion carried. Motion made by Brian Gagne, seconded by Kevin Rooney, to re-open the public hearing. All in favor; motion carried. James Ryckman, 205 Pannell Road (eastern adjoining property), presented his areas of concern: Drainage, existing vegetation and dust control. There was no one else present to speak for or against this application. Motion made by Brian Gagne, seconded by Kevin Rooney, to close the public hearing. All in favor; motion carried.

PB-12-05 - Gardner - Route 350 - Single-family residential site plan - Motion to open the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. Newt Gowdy was present on behalf of the applicant. There was no one else present to speak for or against this application. Motion to close the public hearing made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried.

 

OLD BUSINESS:

PB-11-05 - DeHollander - Pannell Road - Subdivision & single-family residential site plans - 3 lots - This project is 9 residential lots to be completed in two phases. Phase 1, now under consideration, encompasses 3 frontage lots along Pannell Road. Phase 2 will be a cul-de-sac with 6 additional lots. The existing low area will be used for storm water detention. Existing trees/woods will be preserved as much as possible. There will be no disturbances around the Ryckman property. Storm water management plan addresses erosion control & dust issues. Site distances for driveways on the three Pannell Road lots exceed requirements. Previous Board comments were addressed in the revised site plans.

Discussion continued regarding drainage. Town Engineer Scott Allen, Highway Supervisor Dick Roets and Scott DeHollander will be walking the property. Areas to be covered include existing culvert, drainage from detention pond to the culvert and drainage swales. Improved drainage should benefit surrounding properties.

The Wayne County Planning Board recommended entering Lot 1 from the cul-de-sac vs. Pannell Road. Mr. DeHollander felt this was a possibility if the construction of the home on Lot 1 overlapped with the construction of the cul-de-sac in Phase 2. Driveway turnarounds on all three lots were requested.

Final site plan approval was deferred until the drainage issues have been resolved. Motion made by Brian Gagne, seconded by Kevin Rooney, for preliminary approval of subdivision and site plans for Phase 1 (Lots 1, 2 & 3) subject to Town Engineer's notes of 9-12-05. All in favor; motion carried.

PB-12-05 - Gardner (Hamlin) - Route 350 - Single-family residential site plan - Preliminary & final - Newt Gowdy explained changes on the new site plan addressed the Town Engineer's comments & items previously requested by the Board (curtain drain, drainage swale, street trees, driveway width & turnaround). A NYS DOT permit will be needed for the driveway cut. Motion made by Kevin Rooney, seconded by Brian Gagne, for negative SEQR declaration. All in favor; motion carried. Motion made by Kevin Rooney, seconded by Brian Gagne, to grant preliminary & final site plan approval. All in favor; motion carried.

 

NEW BUSINESS:

PB-14-05 - Waterford Properties, Inc. - Wayneport Road - Subdivision & residential site plans - 47 lots - Sketch - Bob Cantwell, BME Associates, was present on behalf of the applicant. The Town Board recently rezoned the project area from R-30 to R-22. This submission is consistent with the rezoning request. Project is 41 acres with 47 proposed residential lots, the same number of lots allowed under previous R-30 zoning. The lots on the east side (abutting the homes on Wayneport Road) will conform to R-30 standards for size, setback and width. The majority of the lots will conform to R-22 zoning and allow preservation of drainage through the middle of the property with larger lots along the southern boundary line. The project includes town-dedicated roads, public water & sewer. A storm water management area is proposed for the northwest corner, and two 30-ft. land strips will be conveyed to the properties adjoining the southern boundary currently accessing Wayneport Road through easements. Project will be done in two phases. Phase 1 plans will be submitted by 9-21-05, and applicant would like to begin earth work this year. Phase 1 will include the connection to Wayneport Road, completion of storm water management and installation of sewer lines. Town Engineer's 9-12-05 Review Letter was discussed. Other items reviewed were flag lots with common driveways & their maintenance; buffering along the north boundary (adjoins GC zoning), possible easements to the old trolley bed and/or use of drainage corridor as walking trail to trolley bed; inclusion of the existing houses on the west side of Wayneport Road in sewer/drainage easements and sewer district; divided entrance with median; and, paved cul-de-sacs. The Board requested a blow up of a typical lot and a specific landscaping plan for the project. It was also noted the shared driveway for Lots 28 & 29 must be 30 ft. instead of 15 ft. shown.

David Benz, 1447 Wayneport Road, requested a privacy berm be constructed between the existing Wayneport Road houses and the project. After discussion, it was decided these issues would be addressed after a grading plan has been submitted.

Motion to declare the Planning Board lead agency for the SEQR process for Waterford Custom Homes/Waterford Land Development LLC, Application PB-14-05, made by Brian Gagne, seconded by Kevin Rooney. All in favor; motion carried. Motion made by Brian Gagne, seconded by Kevin Rooney, to grant sketch plan approval subject to comments made and Engineering Review Letter of 9-12-05. All in favor; motion carried.

PB-13-05 - Warters - Victor Road - Single-family residential site plan - Sketch - Dave Matthews, Matthews Engineering, was present on behalf of the applicant. This lot will be accessed through a common driveway with 1497 Victor Road. Turn-off from the driveway should be appropriately marked for emergency purposes. Motion made by Kevin Rooney, seconded by Brian Gagne, for sketch plan approval. All in favor; motion carried.

 

MINUTES:
