PLANNING BOARD

June 14, 2004

 

PRESENT: Chairman Doug Allen, members Mert Bartels, Tom Ferreri, Mark McEwen, Tom Morrison and Kevin Rooney. Also present were Council Ken Nawrocki and Town Engineer Scott Allen. Absent was Brian Gagne.

Chairman Allen called the meeting to order at 7:31 p.m. Motion to waive reading the Legal Notice as it appeared in the Times made by Kevin Rooney, seconded by Mert Bartels. All in favor; motion carried.

PUBLIC HEARINGS:

PB-05-04 – Messerschmidt - Fawn Drive (Lot 3B) – Site plan – Single family residence – Motion made by Tom Ferreri, seconded by Mert Bartels, to open the public hearing. All in favor; motion carried. Alfred Messerschmidt was present to explain this request. No one else was present to speak for or against this application. Motion made by Tom Ferreri, seconded by Mert Bartels, to close the public hearing. All in favor; motion carried.

PB-07-04 – Rothfuss – 2555 West Walworth Road – One lot resubdivision – Motion made by Tom Ferreri, seconded by Mert Bartels, to open the public hearing. All in favor; motion carried. Applicant Ora Rothfuss and David Matthews, Matthews Consulting, were present to explain this request. There was no one else present to speak for or against this application. Motion made by Mert Bartels, seconded by Kevin Rooney, to close the public hearing. All in favor; motion carried.

PB-09-04 – Crane – 1211 Alderman Road – One lot resubdivision – Motion made by Kevin Rooney, seconded by Mert Bartels, to open the public hearing. Gary Crane was present to explain his request. There was no one else present to speak for or against this application. Motion made by Mert Bartels, seconded by Tom Morrison, to close the public hearing. All in favor; motion carried.

PB-11-04 – Park Woods, LLC – Parkwood Heights – Phases 3B & 3C – Site plan – 21 single family residences – Motion made by Mert Bartels, seconded by Kevin Rooney, to open the public hearing. All in favor; motion carried. Mark Welker of Park Woods, LLC, was present to explain this request. There was no one else present to speak for or against this application. Motion made by Kevin Rooney, seconded by Mert Bartels, to close the public hearing. All in favor; motion carried.

OLD BUSINESS:

PB-05-04 – Messerschmidt – Fawn Drive (Lot 3B) – Site plan – Single family residence – Town Engineer requested a 1" water service be noted on the plan. Motion to grant negative SEQR declaration made by Kevin Rooney, seconded by Mert Bartels. All in favor; motion carried. Motion made by Tom Morrison, seconded by Kevin Rooney, to grant preliminary and final site plan approval in accordance with Engineering Review Letter. All in favor; motion carried.

PB-07-04 – Rothfuss – 2555 West Walworth Road – One lot resubdivision – This is the transfer of property between neighbors (Rothfuss to Tobin). There will be no site development. Parcel will be split from Rothfuss and combined with Tobin. No engineering comments. Motion made by Mert Bartels, seconded by Kevin Rooney, to grant negative SEQR declaration. All in favor; motion carried. Motion made by Mert Bartels, seconded by Kevin Rooney, to grant this realty subdivision per plan submitted. All in favor; motion carried.

PB-09-04 – Crane – 1211 Alderman Road – One lot resubdivision – This is the transfer of 9.4 acres from Rainbow to Crane. Acreage will be added to the Crane's present parcel. This is vacant land containing a large drumlin. No site development will be done. Motion to grant negative SEQR declaration made by Mert Bartels, seconded by Kevin Rooney. All in favor; motion carried. Motion to grant approval for one-lot realty subdivision made by Kevin Rooney, seconded by Tom Ferreri. All in favor; motion carried.

PB-11-04 – Park Woods, LLC – Parkwood Heights – Phases 3B & 3C – Site plan – 21 single family homes – This is final site plan approval for Harwood Lane and the single family homes at Parkwood Heights. Proposal is in line with the original plan and TPD zoning. Prior stages have been completed in a timely manner. SEQR was previously done. Town Engineer Scott Allen noted drainage tiles would be used instead of backyard swales. Motion made by Kevin Rooney, seconded by Tom Ferreri, to grant subdivision and site plan approval for Parkwood Heights Sections 3B & 3C (21 lots) per plans submitted and subject to engineering comments. All in favor; motion carried.

NEW BUSINESS:

PB-08-04 – Senftleben – Wayneport Road – Site plan – Single family residence – Sketch – Dave Matthews, Matthews Consulting, explained this application. Proposal is for a single-family residence on a 6.8 acre parcel. Motion to grant sketch plan approval made by Kevin Rooney, seconded by Tom Morrison. All in favor; motion carried.

PB-10-04 – Song – Wilkinson Road – One lot subdivision & site plan – Single family residence – Sketch – Dave Matthews, Matthews Consulting, explained this application. This is the split of a 12.3 acre parcel into two (2) lots – 1 acre with existing house (Lot #1) and 11.3 acres with existing garage (Lot #2). Access to current house is through driveway easement on the west side. Access to new Lot #2 will be a driveway on 30 ft. strip of land on the east side. This driveway placement was approved in 1992 but driveway was not built. Site plan approval will be for conversion of existing two-story garage into a single-family residence. Utilities will be installed along the 30 ft. access. Tom Morrison questioned previous subdivision restrictions that may have been placed on this parcel. Clerk will research. Motion made by Kevin Rooney, seconded by Tom Ferreri, to grant sketch plan approval pending research of any possible restrictions. All in favor; motion carried.

CLERK'S NOTE: Original site plan approval given 9/28/92; copy of those minutes to be included with current file. No future subdivision restrictions were found.

DISCUSSION ITEMS:

Penta-Tech – Commons Parkway – Robert DeBruin, Penta-Tech, and Joel Hall, LeChase Design Services, presented an expansion proposal for this business. Penta-Tech would like to increase their manufacturing capacity (coated papers). Rough site plans, floor plans and elevations were given to the Board. Exterior of building will match present structure. Two (2) loading docks will be added for a total of four (4), and truck traffic will increase 20-30%. They now have 12 employees with 22 possible after expansion. Current building is 10,000 sq. ft. and addition will be 9,600 sq. ft. Discussion followed on adequate parking, materials used in production, need for sprinklers, fire codes, lot coverage, existing easements and setbacks. This building is presently non-conforming (setbacks) due to code changes. Original site plan provided for future expansion of 11,700 sq. ft. Areas to be addressed when making formal application include: Fire protection, lot coverage, green space, sprinklers, truck traffic, detailed plans showing utilities, drainage, etc., and a short-form SEQR.

Baldwin-Richardson Foods – Blue Heron View – Roger Langer, NH Architecture, presented a proposal for 4,600 sq. ft. of additional office and R&D space. They anticipate adding 3 employees with the possibility of 7-8 more. Staggering shift changes should alleviate any parking congestion. Existing sewer line remains the same with the clean-out being brought up to grade. Drainage and erosion control issues were discussed. Formal application will be made for July public hearing.

MINUTES:

Motion made by Mert Bartels, seconded by Mark McEwen, to approve the 5/10/04 minutes. All in favor; minutes approved. Motion made by Tom Ferreri, seconded by Kevin Rooney, to approve the 5/24/04 minutes. All in favor; motion carried. The 4/12/04 minutes could not be approved due to lack of proper quorum.
