PLANNING BOARD MINUTES

January 12, 2004

 

PRESENT: Chairman Doug Allen, members Mert Bartels, Tom Ferreri, Brian Gagne, Mark McEwen and Kevin Rooney. Also present were Councilman Ken Nawrocki and Town Engineer Scott Allen. Absent was member Tom Morrison.

Chairman Doug Allen called the meeting to order at 7:35 p.m. Motion made by Kevin Rooney, seconded by Mert Bartels, to waive the reading of the Public Notice as it appeared in the Times. All in favor; motion carried.

 

PUBLIC HEARINGS:

PB-27-03 – Soucy – Immanuel Drive – Realty resubdivision – Motion made by Mert Bartels, seconded by Kevin Rooney, to open the public hearing. All in favor; motion carried. Norman Soucy was present to speak on behalf of his application. There was no one else present to speak for or against this application. Motion made by Kevin Rooney, seconded by Mert Bartels, to close the public hearing. All in favor; motion carried.

PB-28-03 – Wyman – 3096 Kittering Road – Realty resubdivision & two-family conversion – Motion made by Mert Bartels, seconded by Kevin Rooney, to open the public hearing. All in favor; motion carried. Kimberly Wyman was present to speak on behalf of her application. There was no one else present to speak for or against this application. Motion made by Kevin Rooney, seconded by Mert Bartels, to close the public hearing. All in favor; motion carried.

 

OLD BUSINESS:

PB-27-03 – Soucy – Immanuel Drive – Realty resubdivision – This is minor movement of property lines among four contiguous lots. Motion made by Kevin Rooney, seconded by Mert Bartels, for negative SEQR declaration. All in favor; motion carried. Motion made by Brian Gagne, seconded by Kevin Rooney, to approve this resubdivision as proposed. All in favor; motion carried.

PB-28-03 – Wyman – 3096 Kittering Road – Realty resubdivision & two-family conversion – This is a change of property line between two adjoining lots to accommodate the required acreage (44,000 sq. ft.) for a two-family residential conversion. Both resulting lots will conform to Code. Residence to be converted to a two family is a ranch style home with walkout basement. First floor unit will be two bedrooms (1,440 sq. ft.) and the second unit be one bedroom (1,080 sq. ft.) in the walkout basement with a garage. Per Ms. Wyman, utilities will be included in the rent; therefore, separate utility meters will not be necessary. Septic was originally designed for three (3) bedrooms and is adequate for this use. Town Engineer will review final conversion plans for egress requirements. Applicant presented three letters and a petition signed by 19 neighbors in support of this project. Motion made by Mert Bartels, seconded by Kevin Rooney, for negative SEQR declaration on this realty resubdivision. All in favor; motion carried. Motion for negative SEQR declaration on the two-family residential conversion made by Kevin Rooney, seconded by Mert Bartels,. All in favor; motion carried. Motion made by Brian Gagne, seconded by Kevin Rooney, to approve this realty resubdivision and two-family conversion. All in favor; motion carried.

 

TOWN BOARD REFERRAL:

Laker Development – Route 31/Wayneport Road – Rezoning request – Present were Kim Thompson, FRA Engineering, and Devin Dal Pos, Laker Development. This request is for 35 acres/4 parcels at the northeast corner of Route 31 and Wayneport Road, primarily fronting Route 31. Present zoning is Office, Research, Manufacturing (ORM) with requested change to General Commercial (GC). The Town's Master Plan calls for approximately 200 acres in this area to be zoned GC, and there is adequate ORM zoning to accommodate any future needs. Existing gas station on this corner is zoned GC, and this change will bring the adjoining area together into one zoning code. Traffic mitigation and specific planning issues cannot be addressed at this time, but will be reviewed when specific site plans are submitted. Board consensus: No concerns. Motion made by Brian Gagne, seconded by Kevin Rooney, for a positive referral to the Town Board. All in favor; motion carried.

 

ZBA REFERRAL:

Z-26-03 – Vienna – 1575 Walworth Road – Area Variance – Section 135-162-B – Expansion of non-conforming building & Section 135-61-A – Garage space more than allowed by Code – Board consensus – Positive referral.

 

MINUTES:

Motion made by Mert Bartels, seconded by Kevin Rooney, to approve the 12-8-03 minutes. All in favor; motion carried. The 11-10-03 minutes could not be approved due to lack of proper quorum.
