PLANNING BOARD MINUTES

August 11, 2003

 

PRESENT: Chairman Doug Allen, members Mert Bartels, Tom Ferreri, Mark McEwen, Tom Morrison and Kevin Rooney. Also present were Town Engineer Scott Allen and Town Councilman Ken Nawrocki.

Chairman Allen called the meeting to order at 7:30 p.m. Motion made by Mert Bartels, seconded by Tom Ferreri, to waive the reading of the Public Notice as it appeared in the Times. All in favor; motion carried.

 

PUBLIC HEARINGS:

PB-13-03 – Dickinson/Pecora – 1376 Canandaigua Road – Realty subdivision – Motion made by Tom Ferreri, seconded by Mert Bartels, to open the public hearing. All in favor; motion carried. Property owner John Dickinson and Bob Seeley of Schwartz Surveying were present to explain this proposal. No one else was present to speak for or against this application. Motion made by Tom Ferreri, seconded by Mert Bartels, to close the public hearing. All in favor; motion carried.

PB-20-02 – Spinosa – West Walworth Road (Forsay Lot #4) – Realty subdivision & site plan – Motion made by Mert Bartels, seconded by Tom Ferreri, to open the public hearing. Cheryl Spinosa was present to explain a proposal to divide this 48 acre parcel into two lots, one of 10 acres with a single family residence and the other of 38 acres for a riding stable.

Robert Dentico & Peggy Richter, 2930 West Walworth Road (Forsay Lot #2), had concerns regarding dust from a gravel driveway and hours of operation. Ms. Spinosa responded that they will consider paving a portion of the driveway to alleviate the dust along the front lots. Hours of operation will be 8:00 a.m. to 9:00 p.m., seven days a week.

Becky Cotter, 2890 West Walworth Road (Forsay Lot #1), inquired about lighting around the barn. Ms. Spinosa indicated this would probably be dust-to-dawn lamps.

Suzanne Norman, 2870 West Walworth Road, questioned the commercial aspects of a riding stable. Scott Allen explained this use is permitted in AR-40 and does not require a Special Use Permit. In the past business hours have been regulated on Special Use Permits but not applications such as this.

No one else was present to speak for or against this application. Motion made by Mert Bartels, seconded by Kevin Rooney, to close the public hearing. All in favor; motion carried.

OLD BUSINESS:

PB-13-03 – Dickinson/Pecora – 1376 Canandaigua Road – Realty subdivision – Preliminary & final – Bob Seeley, Schwartz Surveying, explained this is a simple subdivision of .22 acres from the Pecora property onto the Dickinson property. Mr. Dickinson has maintained this area for several years and wishes to add it to his present parcel. Motion made by Kevin Rooney, seconded by Mert Bartels, to grant negative declaration on SEQR. All in favor; motion carried. Motion made by Tom Ferreri, seconded by Kevin Rooney, to approve this realty subdivision. All in favor; motion carried.

PB-20-02 – Spinosa – West Walworth Road (Forsay Lot #4) – Ms. Spinosa explained this is a 48 acre parcel with a 40 ft. right-of-way access onto West Walworth Road. They would like to divide this into two parcels of approximately 10 and 38 acres, each with a 20 ft. right-of-way access. Forsay Lot #3 shares access with a 20 ft. right-of-way, for a total of 60 ft. on road front. Questions then arose from the Board regarding one driveway for all three lots vs. the two driveways being proposed by the Spinosas (one for Lot #3 and one for the divided Lot #4). Other areas of concern were the hours of operation, amount of traffic going in and out, number of stalls/animals, handicap parking, maximum number of people on the premises, parking during events/shows, hours of operation, width of driveway, dust control, shared driveway with Lot 3, access by emergency vehicles, delineation of utilities on plan, size of water service/hydrant for adequate fire protection, adequate electric service to meet demand for Lots 3 & divided Lot 4, and buffering along adjoining residential lots. Plan needs to be revised to show placement of utilities, type/size of water service, culvert pipe for ditch mid-way along driveway, additional buffering/extension of tree line and lighting plan for the barn. Applicant will return at the 8/25/03 meeting with revisions.

 

NEW BUSINESS:

PB-10-03 – Caton – Yellow Mills Road – Site Plan – Sketch – Dave Matthews, Matthews Consulting, addressed the Board on behalf of the applicant. This is a 20.8 acre parcel. Single family residence will be placed approximately 600 ft. from the highway, using an existing farm lane, with improvements, for access. The entire property boundary has already been planted with pine trees for buffering. Motion made by Kevin Rooney, seconded by Tom Morrison, to grant sketch plan approval. All in favor; motion carried.

PB-11-03 – Whitney – Quaker Road – Subdivision & Site Plan – Sketch – Dave Matthews, Matthews Consulting, addressed the Board on behalf of the applicant. This is a 1.4 acre parcel to contain a single family residence. Due to elevation from the road, access will be obtained by an easement through the adjoining parcel. Motion made by Kevin Rooney, seconded by Mert Bartels, to grant sketch plan approval. All in favor; motion carried.

MINUTES:

Motion made by Mert Bartels, seconded by Tom Ferreri, to approve the 7-28-03 meeting minutes. All in favor; motion carried.
