PLANNING BOARD MINUTES                                                                                            October 14, 2002

 

MEMBERS PRESENT:  Chairman Doug Allen, Mert Bartels, Tom Ferreri, Brian Gagne, Mark McEwen, Kevin Rooney.  Also present were Scott Allen, Town Engineer, and Ken Nawrocki, Town Councilman.  Absent:  Tom Morrison.

 

Chairman Doug Allen called the meeting to order at 7:32 p.m.  A motion to waive the reading of the Legal Notice as it appeared in the Times was made by Mert Bartels, seconded by Kevin Rooney.  All in favor; motion carried.

PB-22-02 - Matzan - Alderman/Leno Roads - 2 lot subdivision & site plan

Motion made by Brian Gagne, seconded by Kevin Rooney, to open the public hearing.  All in favor; motion carried.  Greg Matzan was present to speak in favor of this application.  No one else was present to speak for or against this application.  Motion made by Brian Gagne, seconded by Mert Bartels, to close this public hearing.  All in favor; motion carried.

Motion made by Brian Gagne, seconded by Kevin Rooney, to open this public hearing.  All in favor; motion carried.  Clancy Burkwit, representing the applicants, was present to speak in favor of this application.  No one else was present to speak for or against this application.  Motion made by Brian Gagne, seconded by Mert Bartels, to close this public hearing.  All in favor; motion carried.

PB-31-02 - Chapman - 932 Bunker Hill Drive - Realty subdivision

Motion made by Brian Gagne, seconded by Kevin Rooney, to open this public hearing.  All in favor; motion carried.  Bob Seeley, representing the applicant (Julie Chapman, also present), spoke in favor of this application.  No one else was present to speak for or against this application.  Motion made by Brian Gagne, seconded by Mert Bartels, to close this public hearing.  All in favor; motion carried.

 

OLD BUSINESS:

 

CVS - Rezoning - Northeast Corner Canandaigua Rd/ Route 31

Kim Thompson from FRA Engineering, representing Laker Development, began her presentation indicating changes proposed since the 9-23-02 meeting with this Board.  They are now looking at a sewer extension to the rear of the property instead of going along Route 31.  Project is moving through the SEQR process, with the Town Board being the lead agency.  Scott Allen advised the Board this project will not be before them until property has been rezoned and the application is made for site plan approval.  He distributed a draft memo to the members which incorporated their various suggestions and recommendations.  This memo will be finalized and forwarded to the Town Board.  Brian Gagne questioned if the adjoining neighbor on Canandaigua Road (Marvin) had concerns.  Contact had been made with him and his concerns were:  (1) inclusion of his property; (2) fencing/buffering around his property; (3) area to dispose of his yard waste.  These issues will be addressed.  Motion made by Kevin Rooney, seconded by Brian Gagne, to recommend a positive referral for this rezoning to the Town Board with a letter of concerns.  All in favor; motion carried.  Scott Allen will finalize the letter to the Town Board.

 

PB-22-02 - Matzan - Alderman/Leno Roads - 2 lot subdivision & site plan

Mr. Matzan presented revised plans that addressed the Board's previous concerns.  Driveway for Lot 1 (corner lot) has been moved to Leno Road, and a buffer zone on Lot 2 has been provided along the wetlands.  Motion for negative SEQR declaration made by Brian Gagne, seconded by Mert Bartels.  All in favor; motion carried.  Motion to grant preliminary & final approvals subject to engineering comments made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.

 

PB-25-02 - Sutton/Strand - Kittering Road - 1 lot site plan

Clancy Burkwit, engineer for the applicants, reviewed the Town Engineer's letter.  The Wayne County Planning Board recommended denial of this due to wetland concerns.  This area is not listed on any State or Federal wetlands maps.  Mr. Burkwit explained they are looking for approval of this plan with the stipulation that a letter from the Army Corps of Engineers be obtained.  Kevin Rooney (member of the County Planning Board) felt the County would be satisfied with the fact this area is not on any State/Federal wetlands map.  Motion for negative SEQR declaration made by Brian Gagne, seconded by Mert Bartels.  All in favor; motion carried.  Motion made by Brian Gagne, seconded by Kevin Rooney, to grant preliminary & final approvals subject to Town Engineer's recommendations and Army Corps of Engineers' clearance.  All in favor; motion carried.

 

PB-27-02 - Churchill/Shores - West Walworth Road (Lot #3 - Forsay) - 1 lot site plan

Dave Matthews, Matthews Consulting, explained this is part of a previously approved 4 lot subdivision with the condition that Lots 3 & 4 have a common driveway.  This is Lot 3.  Buffering will also be provided (double row of evergreens) along the west side of this property.  Trees will be planted this fall with the house to be built in the spring.  Tree placements are to be noted on the site plan.  Motion for negative SEQR declaration made by Mert Bartels, seconded by Brian Gagne.  All in favor; motion carried.  Motion made by Brian Gagne, seconded by Kevin Rooney, to grant preliminary & final approval subject to Town Engineer's recommendations.  All in favor; motion carried.

 

PB-28-02 - Ackerman - Victor Road - 1 lot site plan

Dave Matthews, Matthews Consulting, explained this is Lot 2 of the previously approved Weigert subdivision and is the final lot to be developed.  This is an open lot with the north/west boundary a hedgerow.  Trees are not shown on the site plan; however, Mr. Ackerman agreed to plant three (3) trees along the front of the lot.  Mr. & Mrs. Dave Dandino, 1347 Victor Road, immediate neighbors to the east were present & questioned the placement of the house with regard to their home.  Motion for negative SEQR declaration made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.  Motion made by Brian Gagne, seconded by Mert Bartels, to grant preliminary & final approval subject to Town Engineer's recommendations & addition of three (3) trees to the site plan.  All in favor; motion carried.

 

PB-29-02 - Cotter - West Walworth Road (Lot #1 - Forsay) - 1 lot site plan

Newt Gowdy, engineer for the applicant, discussed the Town Engineer's comments.  Site distances need to be documented on the plan.  Mr. Gowdy was reminded that the proposed barn would need to meet setback and size requirements.  Motion for negative SEQR declaration made by Brian Gagne, seconded by Mert Bartels.  All in favor; motion carried.  Motion made by Brian Gagne, seconded by Kevin Rooney, to grant preliminary & final approval subject to Town Engineer's recommendations.  All in favor; motion carried.

 

 

PB-31-02 - Chapman - 932 Bunker Hill Drive - Realty subdivision

Bob Seeley, engineer for the applicant, explained this is a transfer of 28 ft. of property between neighbors due to a misunderstanding of where the lot line would be.  This transfer accommodates a fence that has already been constructed (agreed upon between the parties involved).  The transferred property will be added to the tax parcel of the applicant.  Motion for negative SEQR declaration made by Brian Gagne, seconded by Kevin Rooney.  All in favor; motion carried.  Town Engineer did not have any recommended changes to this plan.  Motion made by Brian Gagne, seconded by Mert Bartels, to grant approval of this subdivision.  All in favor; motion carried.

 

PB-30-02 - Courtney - Corner Pannell/Cline Roads - Fill permit

John Courtney explained his application for a fill permit.  This property was previously perc'd but the deep hole showed a layer of hard pan.  Mr. Courtney estimates 400 cu. yds. of  fill will be required for an area 60' x 80' x 2' deep.  He would like to have the filling done this fall allowing it to settle over the winter to be perc'd again in the spring of 2003.  He is aware that this fill must sit, undisturbed, for one winter season before being eligible to be perc'd.  Motion made by Brian Gagne, seconded by Mert Bartels, to approve this fill permit for a maximum of 500 cubic yards with a one-year time limit.  All in favor; motion carried.

Bill Hammond, Town Supervisor, entered the meeting at 8:25 p.m.

 

Minutes:  Motion made by Tom Ferreri, seconded by Kevin Rooney, to approve the 9-23-02 meeting minutes.  All in favor; minutes approved.

 

Meeting went into executive session at 8:38 p.m. to discuss possible litigation and returned to regular session at 9:35 p.m.
